When you go for a top secret clearance everything is clearly explained to you. They give you options. One of the options is to go talk to a lawyer. Forgetting something is not excepted as a defense. So far that has been their defense.
If I forgot was allowed as a defense whats the point of having security clearances. Everyone could just say I forgot. They must and will be charged to maintain the process and the rule of law.
The same thing goes for perjury. People will be charged.

(9,720 posts)and lots of it was TOP SECRET/COMSEC/NOFORN, etc. I would have expected to be shot if I had lied to obtain the clearance or released any of it to outside agencies as Chelsea Manning did.

(4,379 posts)I am still trying to figure out if they can be charged on multiple counts and do all the lies count as just one charge.

(4,605 posts)and tenuous every day. It's being rapidly attacked, eroded and eaten way, as if by malignant cancer, under the current regime. There are plenty of glaring examples. Sheriff Joe Arpaio's pardon just to name one.

(23,296 posts)While they should be charged, I am skeptical that they will be in the end. There are so many of them that "forgot" things they should have included on their security clearance paperwork. I fear that there are so many instances of this lying that the courts will be full for many years to come. However, if they are allowed to get away with it, we are truly doomed as a country.

(146,262 posts)If you look at the actual language of security clearance forms, you will see the words "may," as in "you may be charged with a felony."
The reality is that few such charges are ever brought for omissions on a security clearance form. It's highly unlikely that most people in high government positions will be charged for such a thing.
People "may" be charged with may crimes, but few are actually charged.
