Actually, General Kelly, USMC Ret.*, ranks at 15 as Chief of Staff of the White House. This is a political appointee position, and totally exempt from the requirements on behavior, speech, and decorum that are imposed on a [by law, non-political] military officer.
To see the difference, note that General Kelly, USMC Ret.* 's former position was head of Homeland Security. This is also a political appointment, not a duty for a serving officer. As such he was charged with hunting down people based on race, color, religion and country of national origin. He served the President, politically, well enough to be promoted to his current, political position.
While he was doing this, the Secretaries of the Army, Navy, Air Force, and Marines were sending out all hands emails stating that the official position of the U.S. Military is that we respect all persons equally.
*Ret: Retired. A retired member of the military is no longer under the Uniform Code of Military Justice, and is a full citizen of the United States, able to engage in political activity and speech that is forbidden to those who are on active duty.
