Preet Bharara: Mueller will watch for Trump's overreaction to Monday arrests before making next move

Speaking with host Jake Tapper, Bharara — who was dismissed by Trump — said the Trump’s history indicates he may lash back, and that could be telling.

“We know from history, at least from several months, that the president of the United States has strong reactions to public events, even events that have been caused by his own actions,” Bharara explained. “So after he fired Jim Comey, he went on television with [NBC’s] Lester Holt and said some things that were incriminating in connection with a obstruction investigation. He said he fired Comey with, being on his mind, facts related to a Russia investigation.”

“So I would look for a couple things,” he continued. “I would watch and see if Donald Trump has a reaction and talks in away that could be used against him in the future. The second thing I would look at is if the president sends some kind of message to the potential defendant or at other witnesses. Is he sending a message of intimidation in some way thorough himslef and his cohorts, suggesting that people should not be talking and should keep their mouths shut?”

The former U.S. Attorney also suggested that Trump could use a presidential pardon to temporarily derail the process.

One very pleasant surprise about our President is how smart he really is. He has done some things since the election that seemed (at the time) silly/stupid/impulsive but have actually been brilliant tactical moves. I knew he would be pro business, anti regulation and pro secure borders but I didn’t expect his chess game to be as sophisticated as it is. I am really impressed.

If Jarred is pardoned, by definition, it admits his guilt, and trump's knowledge of his crime, and also trump's own guilt.

So, he really can't pardon anyone.

He's very much into short-term solutions so I can see him pardoning Jared if that's who gets charged. It doesn't matter if it makes him look guilty as long as his supporters don't think so and Congress is unwilling to impeach. Plenty of time to arrange a resignation and Pence pardon for him.

Kushner has some questionable financial dealings as well, but I don't think Kushner gets indicted yet.

I have no doubt Mueller has a long list of things for which he could charge Kushner or any of his and the Dotard's other associates. He doesn't have to indict them on all of it at the same time. He'll have other things to nail him on later. Not to mention that there will likely be state charges pending, as well. The President (or anyone squatting in that job, as we have now), cannot pardon anyone guilty of state convictions. I think Mueller is going to just let the indictments trickle out, like "Chinese water torture."

Pardons had legal standing from presidents not under investigation, but in this circumstance I don't see how a presidential pardon could or should legally stand.

No one should be above the law, especially a president whose unconstitutional actions in office have been so much more treasonous than a sexual liaison.

It is not naive or ignorant to want law and order to work this way in an eroding democracy.
