Trump Signs Bill Revoking Obama-Era Gun Checks for People With Mental Illnesses
President Donald Trump quietly signed a bill into law Tuesday rolling back an Obama-era regulation that made it harder for people with mental illnesses to purchase a gun.
The rule, which was finalized in December, added people receiving Social Security checks for mental illnesses and people deemed unfit to handle their own financial affairs to the national background check database.
Had the rule fully taken effect, the Obama administration predicted it would have added about 75,000 names to that database.
President Barack Obama recommended the now-nullified regulation in a 2013 memo following the mass shooting at Sandy Hook Elementary School, which left 20 first graders and six others dead. The measure sought to block some people with severe mental health problems from buying guns.

(6,324 posts)In the United States we have a thing called Due Process. Its pretty important.
The rule that was revoked, that would have been struck down in court anyway on Constitutional grounds, was that anyone who had a representative payee for their social security payments was blanket denied their right to bear arms. Despite that fact that there are many reasons that someone can have a payee, many that are not mental health related, and there is no due process that in the process. It would have just blanket denied rights to everyone.
There is a right way to do this that protects the rights and due process of people. This wasnt it. And that isnt an NRA talking point, its one from the ACLU and disability advocates.
