Ok, if he kissed her without consent then he's wrong, but that looked like comics goofing around, not a serious attempt to sexually gratify himself.
He certainly wan't trying to hide it: He clearly knew he was posing for a picture. That's nothing like trapping the women alone.
Ok, maybe he was really out of line, and apparently he was not a good sport about her refusal afterwards. Not going to try to defend that.
But this photo does not look like he's touching her at all: It's goofing around. Only those in the group would know if this was something that these people did routinely.
He knew she would find out about it later.

If they subject Franken to an ethics investigation, I want to see one on trump as well!

Now, if he kissed her and she was not into it and then he punished her at work for not going along, he was dead wrong.
I have not heard that he was a direct supervisor or that he had the power to affect her career.
But the photo, at least, looks like nothing, imho.
