2 men sentenced for roles in shooting death of 5-year-old Payton Benson

Source: Omaha World Herald

By Kevin Cole and Todd Cooper

Saying that cooperation with authorities must be balanced with culpability, a Douglas County District Court judge sentenced two men to prison Monday for their part in the slaying of a 5-year-old Omaha girl.

Adonus R. Moses, 24, of Omaha, pleaded no contest to conspiracy to commit first-degree murder in connection with the Jan. 15, 2014, shooting death of Payton Benson. Judge Marlon Polk sentenced him to eight years in prison. He said Moses will receive credit for 466 days in jail and will be eligible for parole after serving four years.

Jacob Brown, 22, pleaded guilty to conspiracy to commit first-degree murder. Polk sentenced him to six years in prison. Brown could be eligible for parole in three years and also will be credited with time served.

Polk also sentenced Kevin Peak, 21, who was not present during the shooting, to 394 days previously served. Peak had pleaded guilty to attempted possession of a weapon and was the first person to come forward to police and help identify the men involved in Payton’s death.

driving around looking for rival gang members. They came forward and helped the police identify the killer. A couple of them did shoot, but didn't hit anyone. Peak wasn't even there, apparently.

The killer, Hicks, got 65 years.

No background checks because it inconveniences the "law abiding straw purchaser" from selling the gun he just bought. Got to have military quality battle rifles and pistols available to everyone with cash.

Guns are sooooo special.

Among other endearing qualities...

"Straw purchase" is illegal and people are regularly convicted for it. Therefore the phrase "law abiding straw purchaser" makes no sense, and neither does the implication that background checks would have stopped gang members who could not buy guns legally anyway. Your off-topic word salad rant is ironic considering all your kvetching yesterday about not being able to find someone "capable of making cogent points" on the subject.

Given your obvious error, I wonder if you are "actually willing to consider that an opponent might have a point" and "reasonably discuss" the matter, as you so passionately claimed you desire to do? I somehow doubt it.

Austerity hits the innocent the hardest. This is way to high a price to pay.

should have been, at the least, given life in prison. Again, if the child had been white, those men who shot would be heading toward execution. Black life, no matter who takes it, is always treated less than 'privileged' citizens of this society. So nice try.
