Man accused of threatening to kill Kalispell children wants charges dropped

KALISPELL – The lawyer for the man accused of threatening on social media to shoot dozens of Kalispell school children filed motions to dismiss the charges on Wednesday.

Public defender Brent Getty argues two constitutional challenges to the felony charges of intimidation and criminal defamation levied against David Joseph Lenio by Flathead County.

Getty also asked District Court Judge Heidi Ulbricht to dismiss the intimidation charge on the grounds that the state has not shown a crime was committed, and that the allegation fails to identify a specific person or purpose as required.

From Feb. 12-15, Lenio allegedly tweeted dozens of messages saying things such as, “I want to shoot up a school,” “I may kill kids,” “I bet I could get at least 12 unarmed sitting ducks if I decide to go on a killing spree in a #school,” and “Why the hell shouldn’t I shoot up a synagogue for what the jews (sic) did to US?”

as long as the person has the means to carry it out. He did. When arrested police found:

Authorities found the .32-caliber Caltech semiautomatic pistol he used for concealed carry in the vehicle, along with ammunition, marijuana, a pipe and jugs of urine.

At his home, they found a 9 mm semiautomatic rifle and Russian-made bolt-action rifle, along with more ammunition, that Lenio’s roommate told authorities Lenio had just brought into the residence from a storage unit.

The defense is he threatened to kill so many people that his threats should not be taken seriously.
