'Our plan is to proceed with the executions,' Ricketts (R-NEBR) says of 10 men on death row

LINCOLN — Gov. Pete Ricketts said Friday that despite the repeal of Nebraska’s death penalty, the state will not cancel its order for new drugs to carry out a lethal injection execution.

Ricketts said he agrees with the state attorney general that Nebraska, once it receives the drugs, should be able to execute the 10 men currently on death row.

"Our plan is to proceed with the executions," the governor said, at a press conference marking the end of the 2015 legislative session.

Ricketts said he had no timetable for when the lethal injection drugs purchased by the state from a broker in India will arrive in Nebraska.

The drugs can't be imported into the US, the FDA will stop the importation.

So what is Ricketts going to do?

on death row in Nebraska will be tied up in the courts and ultimately will not be executed.

It is interesting about the point that a legislature cannot change a sentence that has been ordered by a court. I wonder how this was handled back when the U.S. Congress passed a federal law banning the death penalty?

I seem to recall that most times a State ends the death penalty that they cease immediately. The death penalty is commuted to life in prison. (Not sure if this is usually done by the Governor or if language goes into the bill.)

My guess it because the governor is pissed that his veto was overridden will not do the "usual" and commute the sentences to immediately be in line with the new law. More about ego or politics than doing the right thing, morally or as example of being law abiding to his constituents.

Can't he be arrested for importing drugs with the stated goal of using them to murder people?
