Kim Davis released, but judge bars her from withholding marriage licenses

Kim Davis, the Kentucky clerk who was jailed in contempt of court for refusing to issue same-sex marriage licenses, cried and smiled as she stood before a crowd of supporters after her release from jail Tuesday.

"Thank you all so much. I love you all so very much," she said. "I just want to give God the glory. His people have rallied, and you are a strong people."

Davis plans to return to work this week, attorney Mat Staver told reporters. Asked by a reporter whether her stay in jail was worth it, Davis smiled and nodded.

"I can guarantee you, knowing Kim, she loves God, she loves people, she loves her work, and she will not betray any of those three," Staver said. "She'll do her job good. She'll serve the people...and she'll also be loyal to God, and she's not going to violate her conscience."

“When this started, this lawyer said he needed an accommodation for a woman who wanted one. She said she didn’t want her name on a license for gay people,” Shepard Smith noted. “Now they’ve come up with one, they’ve let her out of jail. But it’s not what they want.”

“This is what they want -- what you’re hearing now and this is what they’re going to get -- stirred up argument and a couple of days in the news cycle, and they’re going to be able to make these claims.”

Their religion doesn't apply to other people who don't believe what they do. It's about hate. It's no different than when the haters wouldn't allow interracial couples to marry. Religion is just the thin veil they use to cover their hate.

It would be easy to write a story mocking the application’s histrionics and thinly veiled animus. But quite frankly, I’m growing a bit concerned about Davis’ lawyers. Davis is being represented by the Liberty Counsel, a far-right fringe group that specializes in anti-gay litigation. (Naturally, it is also a Christian ministry and a tax-exempt nonprofit.) Founder and Chairman Mathew D. Staver has used Davis’ case to raise money and boost publicity for his group, going so far as to hold a rally for Davis. In his spare time, Staver has continued to participate in the Faith and Freedom radio show; in recent weeks, he has described the newly gay-tolerant Boy Scouts as “a playground for pedophiles” and compared acceptance of Obergefell to turning over a Jew to the Nazis.

Law firms regularly use sexy cases to increase their own profiles, and it’s perfectly fine to bandy about your client to further a constitutional cause. (Gay rights litigators do it all the time.) But Staver is taking things too far. The first sign of trouble arose early in the case: When a federal judge ordered Davis to issue licenses or be held in contempt of court, the Liberty Counsel advised her to disobey the ruling. Good lawyers don’t usually tell their clients to defy lawful court orders, especially when jail time is a real possibility. Yet the Liberty Counsel didn’t mind putting their client at risk—perhaps because the idea of a middle-aged woman being hauled off to jail for purportedly following her conscience would send thousands of anti-gay Americans reaching for their pitchforks (and checkbooks).

Now the Liberty Counsel has filed an angry, rambling application to the Supreme Court that is little more than an anti-Obergefell rant dressed up as a legal document. The fact that Davis’ lawyers couldn’t tone down the animus for long enough to pen the application is distressing but not surprising. More and more, it’s beginning to look like the Liberty Counsel is taking Davis for a ride, using her doomed case to promote itself and its extremist principles. Davis has certainly humiliated and degraded the gay couples whom she turned away. But I wonder if, on some level, she isn’t a victim, too.

Davis sees herself as a Christian soldier in the battle against the evil gays and their marriage equality. Staver sees her as a means to an end.

county clerks to go to jail for a while to delay justice. Then claim she had no influence over them.

Or get them to tell clients that the licences are invalid even tho the Attorney General has affirmed that they are. Maybe going against the AG will get her censured and impeached. Or maybe they will get the DMV to issue licences and then those employees can plead religious freedom exemption.

This will never really end and their dream of the Supreme Court applying exemptions is just that, a pipe dream.

means that she will have to put a sock in her mouth and place her hands under her butt, and sit there like a bump on a log---------------and that's not going to happen.



She deserves to get what will eventually happen to her--------------a big fine and a long jail sentence. and I hope the judge says that it must come out of her own pocket and not by some crowd sourcing, a bigot is still a bigot and hiding behind a shield of a "god' mantra and wanting a theocracy is just that a theocracy .

Since the Huckster said that he would sit in her place, I think the judge should come out and say there will be no outside interference on this matter, since this guy rails against the courts and is supposedly follows the ten commandments of thou shalt not lie, well he didn't pass that litmus test when he began selling snake oil on t.v.




And what can we say about Cruzless, just think if he became president what he would do with the human beings that didn't believe in his "god" and with his bigotry, and whats really classic instead of being at Congress to get to know the rules for the new session, he goes gallivanting around on the taxpayers dime($174,000), while at the same time doing absolutely nothing on infrastructure work, unemployment benefits , reinforcing Medicare and Social Security, and he's leading the charge to shut down our government because of some tapes being edited and altered by CMS and there cronies, on Planned Parenthood----------------what a hypocrite

I wouldn't have someone like that represent me for littering, but she isn't seeking capable council so much as spiritual reassurance. As such, she'll get every bit of the competent legal advice she's paying for.

That other people in the office would issue the licenses? I hope every couple that walks in the office has ACLU on speed dial.

I don't remember this kind of circus when the pastors and church members who fed the homeless in the park were arrested, and I can make a much better Biblical case fer feeding the hungry than she can for refusing licenses.

A quick look on Google said there are 4,200 religions in the world today,
a dozen of these were classified as "major world religions".

I don't know what the process is in KY, but in CA, marriage a multi-step process.

You go to the country clerk who issues a license. The marriage is performed. The person who performs the marriage, completes the license (time, place, date, officiant, and witnesses) signs it and returns it to the country clerk.

Then, the county clerk records the completed license. At that point, as far as the state's concerned, the marriage becomes official -- not at the original issuing of the license and not at the end of the ceremony. For a couple to prove they're married, they need a copy of the recorded completed license.

If the county clerk just shoves the completed license into her bottom drawer -- or worse still, shreds it -- then there is no record of the marriage. The couple can't get a certificate of marriage and can't prove they're married.

The judge ordered her to issue the license. Unless he also ordered her to record completed licenses AND issue marriage certificates, she can still cause trouble.

I am sure the ACLU lawyers (who are much smarter than Kimmie's) have already thought of that and will be sure that any gay marriage in Rowan county is properly recorded. If not, more court time for Little Miss Bigot.

unless they are gay, of course. They should have kept her until she agreed to do her job or resign. Having other people do it for her is a cop out. What if she is the only one in the office some day, and a gay couple comes in? She agreed to uphold the US and Kentucky constitution, if she can't do it she can go pound sand.

She and her clan are fantasizing that she won by getting released from prison. Her office is issuing licenses. She is on a very short leash. Perhaps it will take several millenniums for people like her to enter the 21st century.

Best to not turn her into Juan D'Arc and have her clan of gun huggers going on shooting sprees.

but I do advocate cooling her heels in jail until she does her job or quits. Americans have a short attention span, after a couple weeks in jail she would be forgotten.

she gets paid 80k a year. She doesn't want to lose her gravy train. Her husband, dressed as everyone's ideal hillbilly doesn't help our commonwealth. Who wants to bring jobs to a bigoted state that can't even elect folks that will do their job? The whole mess is an embarrassment to our state and region. Rowan County is just 25-30 miles east of where I live. She and her clan are an embarrassment to everyone in the region. Stupid backward woman. Their logic leaves me speechless.

If a gay person were elected to her seat (or any seat), could that person then refuse to issue marriage licenses to straight people on the grounds that it was against their beliefs.

I'm guessing she'll let her assistant clerks issue the licenses and not fuck with them.

But if she's really stupid, she'll be duped by the holy roller assholes into interfering somehow and land back in jail.
