U.S. judge rules Republicans can pursue Obamacare lawsuit

A U.S. judge said on Wednesday congressional Republicans could move forward with parts of a lawsuit that alleges executive overreach by President Barack Obama's administration in implementing his signature healthcare law.

U.S. District Judge Rosemary Collyer, appointed by former President George W. Bush, a Republican, said the House of Representatives has standing to pursue claims that the secretaries of health and human services and of the Treasury violated the Constitution by spending funds Congress did not appropriate.

At the same time, Collyer determined they could not pursue claims that the Treasury secretary improperly amended the healthcare law, as those concerned only the implementation of a statute and not adherence to any congressional requirement.

Collyer did not rule on the merits of the claims, only on the administration's motion to dismiss the lawsuit on the issue of standing, a requirement in U.S. law whereby plaintiffs have to show they have been directly harmed.

Just give us single payer and we'll work with it. Expand Medicare every year until it covers everyone. The Dems caved and co-opted the Heritage Foundation idea and re-branded as Obamacare/ACA. When will it end? Can you imagine Hillary Clinton proposing Newt's healthcare plan (back when she was trying to reform healthcare) and calling it a democratic idea? We've been played people.!

we could not lose even one Democrat - and Lieberman, Lincoln, and others were on record against it. But, your point is incredibly well taken.

As to single payer, Bernie Sanders spoke then of having only about 10 Senators behind it. (Note I assume that includes Kennedy, Dodd and Kerry ... and likely Harkin - all gone from the Senate. )

We may see a major swing in congress with this next election too as Republicans have more seats to defend than Democrats.

I don't agree often with Larry Sabato - he is pretty far to my right and pretty "Southern", but this looks reasonable to me.

when Nixon proposed it He rejected it because the labor unions wanted even more.

Asked about his greatest regret as a legislator, Ted Kennedy would usually cite his refusal to cut a deal with Richard Nixon on health care.

Remind me why we pay for representatives who are trying to decrease the hard earned quality of this country. They're un-American.
