Judge rejects latest stay request from Kentucky clerk Davis

A federal judge on Wednesday denied Kim Davis a stay of his order requiring her office to issue marriage licenses to all eligible couples who want one, the latest setback for the Kentucky county clerk who went to jail rather than issue licenses to gay couples.

Lawyers for couples suing Davis have said that since her return to work, the Rowan County clerk has interfered with the issuance of marriage licenses in violation of orders by U.S. District Judge David Bunning's in Louisville.

An attorney for Davis has said she has made a good-faith effort to comply with Bunning's orders. She has said licenses granted by her staff are invalid because she has not given them that authority.

Her latest request stems from Bunning's order making it clear that his decision applied to all eligible couples and was not limited to the same-sex and opposite-sex couples who had sued Davis.

She is "washed clean." I saw it in an interview. She said so.

Actually, I am a Christian. But I don't think grace works the way she is interpreting it.

requirements only. It is not your job or place to insert your own requirements. If you cannot do this relatively simple function of you position you need to resign!

It's an outrage that she continues to be paid for not doing her job. She will stand her ground only until her job security/paycheck is threatened.

These low level rural county officials are highly overpaid, but that's a different issue.

35 years ago, but I'm feeling a trifle confused about the issuance of marriage licenses. Do they need to be in the county in which you're being married? I'm thinking the answer is yes, which is a lot of what the brouhaha is all about here.

The other thing I wish people would concentrate on is that she refused to issue any marriage licenses at all, even to heterosexual couples, which ought to have been far outnumbering the gay couples -- although I could certainly be wrong here -- meaning no one could get married in her county.

I'm myself a boring heterosexual, a woman, who married a man some years back, and I can imagine how incensed I'd have been if we'd been unable to get a license just because the clerk in the county wasn't issuing any licenses at all. Excuse me? What the fuck is the problem?

An addendum here: A year or so ago I was at an event where a man casually referred to his husband, and a couple of hours later, same event, a woman equally casually referred to her wife. I finally got it. If you're a woman and you're married you're a wife. If you're a man and you're married you're a husband. People who want to marry should be able to. One person at a time, and keep it within the species. No other rules need apply.

They want their marriage license to reflect the county in which they live.

I saw an interview a few weeks back - before Davis went to jail - with one couple that said since she is willing to take their tax payments she should be willing to provide the other services required for her office. They said they could drive to the next county, get a license, get married in Rowan County, but then they would have to take the completed license back to the other county and the records for their marriage would be somewhere other than where they live.

I'm with you - I'd be upset that no one could get married in my county. Kim Davis was and is refusing to provide a service that is part of her job description. She is being paid by the taxpayers of that county - she should do all the services for her position.
