The Latest: Remaining Oregon occupiers say they want pardons

Updated 3:37 pm, Friday, January 29, 2016

BURNS, Ore. (AP) — The latest on an armed group that took over buildings at a federal wildlife refuge in Oregon (all times local):

1:35 p.m.

The last few occupiers of an Oregon wildlife refuge have posted another video in which they say they want pardons for everyone involved in the nearly monthlong standoff.

Four people remain at the Malheur National Wildlife Refuge. In a video posted Friday to the YouTube channel "DefendYourBase," which the group has been using to give live updates, the occupiers said they were in contact with the FBI.

A speaker believed to be David Fry said he asked the FBI whether it was possible to "get out of here without charges," but "they keep saying that's not possible."

The Bundy's can rot in jail. Although it would be hard to swallow, I might support the pardon of the four left at the refuge, if everyone in prison receives a pardon as well, for possession of pot. If you are pardoned, are your voting rights reinstated?

They should be told to put their guns on the ground, their hands in the air, and to come on out of there. Period.
If they don't, the place should be completely surround, any utilities shut down, and the noose tightened until the crawl out on their bellies begging for water and food.

Then charge them with federal offesnse that such a pardon does not cover. You can also do the reverse have Obama issue a Federal pardon and when they surrender charge them with state charges. A fedreal pardon does NOT affect State charges.

Issuing one but not the other may get these idiots to surrender and end this debacle, and they are stipif enough not to understand they need both pardons to stay out of jail. They have committed both federal and state crimes here. Breaking into a building you have no right to enter is a state crime. Breaking into a federal building is a federal crime. Thus crew did BOTH. Thus do they spend time in a federal or state penitentiary is the only remaing question and that can be resolved by who issued the pardon.

Yea, that is probably not going to happen. You can't be part of a group that takes over a federal site, destroys federal property, threatens harm and gets into a shoot out with federal agents that leaves one person dead and then be like "our bad, can we just got home and forget this ever happened"

Ya'll are gonna do some time for this one.

"Dear God, please make it go away". I can commiserate, I've made some pain inducing choices in my life, but my full sympathy is reserved for if/when they grok where they went wrong.

Let's hear their allocution, and with that their exhortation to their compatriots to not follow in their footsteps. But that's for after they get lawyers. Right now their trying to negotiate, instead of just asking how they should surrender, shouldn't be earning them anything. If anything, it goes to them exhibiting a state of mind* that has contempt for the rule of law.

https://en.wikipedia.org/wiki/Allocution

In plea bargains, an allocution may be required of the defendant; the defendant explicitly admits specifically and in detail to what he or she did and for what reason, in exchange for a reduced sentence. In principle, it removes any doubt as to the exact nature of the defendant's guilt in the matter.

I remember hearing about that while watching The Sopranos. Johnny Sack was derided for complying with the government's insistence on him doing that in order for him to gain any concessions for his family's benefit.

Johnny's efforts to maintain control of his family ultimately proved futile. His lawyer, Ron Perse, floated the possibility of cooperating with the FBI, but John was quick to dismiss this. However, as the trial neared, Ron arranged a deal with the government on Johnny's behalf. Facing a massive asset seizure that would have left both him and beloved wife destitute and a case he could not possibly beat, Johnny pleaded guilty to 47 RICO predicates for a reduced sentence of 15 years and a fine of $4.1 million — effectively ending his position as boss (but still leaving Ginny enough money to live comfortably). As part of the deal, he was also required to give an allocution admitting his involvement in organized crime (although he did not reveal the names of any associates). Members of both the Soprano and Lupertazzi families were angered by his allocution, believing that John should have stood trial before admitting anything regarding La Cosa Nostra. Johnny was now serving 15 years in federal prison, and was considered persona non grata among his former associates.

https://en.wikipedia.org/wiki/Johnny_Sack

*They might truly be in a fantasy land, where all the make believe legal jumbo they throw around actually has weight. Shame on us if we enable this mindset any further. Though I'm OK with cutting them some slack at sentencing time because they are delusional. That really should be their defense.
