Appeals court rejects request to rehear Gloucester transgender bathroom case

A federal appeals court will not revisit a three-judge panel's ruling in favor of a transgender teenager battling the Gloucester County School Board over its bathroom policy.
The Richmond-based 4th U.S. Circuit Court of Appeals on Tuesday denied a petition by the school board seeking to have the case reheard by the full court. The decision could move the potentially far-reaching case closer to review by the U.S. Supreme Court.
Judge Paul V. Niemeyer, who dissented in the earlier ruling, did so again in the rehearing denial, which came after no judge requested a poll on the petition. In his dissent, Niemeyer said he chose not to request such a poll because "the momentous nature of the issue deserves an open road to the Supreme Court."
"Time is of the essence, and I can only urge the parties to seek Supreme Court review," Niemeyer wrote.

Gloucester Countys School Board will appeal a federal court ruling on bathroom access for a transgender student to the U.S. Supreme Court.
The 4th U.S. Circuit Court of Appeals ruled last week to deny the School Boards appeal asking for the full court to rehear a three-judge panels ruling in favor of a transgender student suing the district for the right to use the boys bathroom.
The Richmond-based appeals court agreed Tuesday to hold off making its ruling final while the Supreme Court decides whether to take the case.
The three-judge panels ruling in April overturned a district courts denial of a preliminary injunction, saying the lower court judge was guided by erroneous legal principles.

That filing two days ago had triggered an automatic stay on the pro-trans April order while the Court considered their demand. The vote today was 2-1. Equality Case Files has todays ruling.
