Supreme Court split 4-4 over in Native American tribal court dispute

The U.S. Supreme Court on Thursday allowed a child sexual molestation lawsuit against discount retailer Dollar General Corp to move forward in a Native American tribal court in Mississippi.
The justices were split 4-4, leaving intact a lower court decision that said the Mississippi Band of Choctaw Indians' tribal court can hear a family's civil suit accusing a male manager of a Dollar General store located on tribal land of molesting a 13-year-old boy. Dollar General, questioning the impartiality of tribal courts, argued the suit should have been filed in state court because it involved a non-tribe member. The decision sets no nationwide precedent on tribal court jurisdiction

(1,178 posts)If it becomes clear that the SCOTUS will have a Democratic majority, then Thomas will serve no useful purpose by being there, even by holding his spot until a Republican becomes President. He could be making many millions of dollars in the private sector and I would expect that temptation to be too much for him.

(23,059 posts)Think of all the laws decided correctly by left leaning judges that are allowed to stand because of the tie. Scalia would have shot them down. So, it's a mixed bag at this juncture.

(26,217 posts)If it is then I dont see how they are going to be able to collect on dollar general other that seizing the store and all its property which is risky because I suspect alot of businesses will be reluctant to build on tribal land if they do that.

(1,178 posts)The issue is whether US federal courts will grant full faith and credit to tribal courts. I did a very quick look and am not convinced that the issue is resolved fully.

(3,051 posts)This looks like a really good way to get home-cooked if you do business on a NA reservation.
Lacking all knowledge except how lawsuits go down in little towns (which is what a reservation is for this purpose), the outsider gets cooked.
The practical effect is people won't do business on reservations, which sucks for tribes who need work/investment.
I have no opinion on the merits, otherwise.
