Maricopa County Sheriff Joe Arpaio officially charged with criminal contempt

With a federal judge's signature on a proposed order initially submitted by prosecutors Oct. 17, the deal is sealed: Maricopa County Sheriff Joe Arpaio is criminally charged with federal contempt of court.

A trial is set for Dec. 6 in U.S. District Court in Phoenix.

Since early 2015, criminal-contempt charges have loomed over Arpaio, the potential consequence for violating a federal judge’s order to stop enforcing civil immigration laws.

The threat of criminal prosecution became increasingly likely after a prolonged series of hearings last year. A federal judge’s finding of civil contempt came in May 2016, followed by his referral for criminal prosecution in August, followed by the Department of Justice’s announcement on Oct. 11 that its attorneys would, in fact, prosecute the six-term lawman.

Susan McDugal was asked to answer several questions before a grand jury and refused. After she served the maximum 18 months the judge had no choice but to release her, though Susan could have gotten out of jail anytime during her stay by appearing before the grand jury and answering their questions. The federal government then tried to charge her for criminal contempt and obstruction of justice, but the jury hung on contempt and acquitted her on obstruction. She did spend some time imprisoned on charges for fraud and conspiracy as another Former9thWard mentioned.

Joe Arpaio is being charged for criminal contempt. There is no get out of jail free card with criminal contempt. If he is convicted, he will have to serve whatever sentence is imposed (up to six months imprisonment and a $1000 fine).

I wasn't able to find much with Google, only that the maximum penalty is 6 months imprisonment and a $1000 fine. If the judge feels that Arpaio is thumbing his nose at the court system, is there anything that would prevent him or her from throwing the book at Arpaio and imposing that maximum penalty?

But judges are required to look at a defendant's past criminal conduct and Arpaio has none. Also federal judges, although appointed for life, look at the morning headlines whether we like it or not. A judge is not going to sentence a 84 year old, who has a great deal of popularity in Arizona and elsewhere, to prison. That just is not the real world.

I had always thought that contempt was something wholly in control of the judge, that one is "held in contempt" or "found in contempt." Yet this appears to be a criminal charge with a trial and the whole ball of wax. What is the difference?

Civil contempt is meant to try and force the defendant into doing something the court wants -- like testifying before a grand jury or pay child support. Civil contempt sanctions typically end when the party in contempt complies with the court order, or when the underlying case is resolved. Criminal contempt is meant to punish the defendant for past deeds.

Those held in civil contempt must be given notice of the contempt sanctions and an opportunity to be heard, but usually are not guaranteed a jury trial. Also, their contempt does not need to be proven beyond a reasonable doubt, while criminal contempt charges must be proven beyond a reasonable doubt. Finally, criminal contempt involves a specified sentence (jail and/or fine), while civil contempt sanctions can be more indefinite, lasting until either the underlying case is resolved or the party in contempt complies with the court order.

One charged with criminal contempt generally gets the constitutional rights guaranteed to criminal defendants, including the right to counsel, right to put on a defense, and the right to a jury trial in certain cases. Charges of criminal contempt must be proven beyond a reasonable doubt.

Joe Arpaio was charged with criminal contempt because the judge thought his actions over the years were a deliberate defiance of the court's orders. His contention is that it was not intentional. The judge has said the maximum sentence should be 6 months in jail which means its a misdemeanor.

I was unaware of the fact that there were two kinds of contempt. Makes sense, since there are civil suits for all sorts of criminal activity.
