Judge orders White House to list people excluded by Trump ban

Source: Reuters

03 FEB 2017 AT 16:47 ET

A federal judge in Virginia ordered the White House to provide a list of all people stopped from entering the United States by a travel ban imposed last week on citizens of seven majority-Muslim countries by President Donald Trump.

The ruling came on a day that attorneys from four states were in courts challenging the executive order. The Trump administration justified the action on national security grounds, but opponents labeled it an unconstitutional targeting of people based on the religious beliefs.

The State Department said on Friday that less than 60,000 visas previously issued to citizens of Iran, Iraq, Libya, Somalia, Sudan, Syria and Yemen had been invalidated as a result of the order. That disclosure followed media reports that government lawyers were citing a figure of 100,000.

U.S. District Judge Leonie Brinkema in Alexandria, Virginia ordered the federal government to give the state a list by Thursday of “all persons who have been denied entry to or removed from the United States.”

Because all the opposing attorneys need to do is find one person denied entry or removed who is not on the governments list and, 💥 goes their credibility.

If the administration even bothers complying, they'll be looking around going "Okay, who did he nominate to be in charge of making lists?"

They're good at it.
They probably don't even care if they win as long as they tie things up in court.

If the court orders visas restored, and they go "Okay, will the specific person named Mohammed Abdul come and get your paperwork? ...Next, the person named Mohammed Al Bahri..."

It'd be like saying "Would the John Smith who lost the winning lottery ticket come claim it?"

(Not at all that I think people would necessarily take advantage, just that they wouldn't risk just handing in a random list of common names of people they wronged. That'd be like a reverse watch-list.)

I just got an alert that a Boston judge declined to renew a restraining order against the travel ban.
There are going to be a variety of rulings on this requiring the Supreme Court to settle it.

Ex-parte restraining orders (where only one side asks for it, without the other side being present) are often not renewed. They're issued on an emergency basis, because of imminent damage, but the parties are supposed to get together and try to reconcile before the TRO expires. Of course, with President Bannon, the assumption that parties will behave reasonably flies right out the door.

eta: (Not "reconcile" all their differences, but arrange to appear before a court with all their arguments marshalled).

She has been in the middle of many interesting cases.

She presided over the Zacarius Moussoui trial, the 20th hijacker from 9/11.
