Newt Gingrich Calls For 'Independent' Investigator In Trump-Russia Probe
Source: Talking Points Memo

Former House Speaker Newt Gingrich said Tuesday that President Donald Trump should choose an "independent person" to investigate allegations that his aides were in contact with Russian officials before the election.
"Find a very smart, independent person, maybe somebody like Michael Mukasey, the former attorney general," Gingrich said on "Fox and Friends." "Put them in charge of the whole project and say, there are questions here."
He said that Trump should "take a lesson from the past, from Ronald Reagan and others" and choose "one person who coordinates the administration on that topic."
"Because it's the kind of thing that can grow, and it looks early on like it's not a big deal, and then one morning it's a big deal and now it's really expensive to deal with," Gingrich said. "The earlier they have a central person directing their efforts, the less problem it will be, the faster it will go away."

(23,003 posts)Without reading the article, the headline is totally correct. We need an independent prosecutor because Repugs will refuse to hear any evidence of wrong-doing. They are all part all the time and don't give a shit about country or world.

(5,730 posts)Sessions, Comey, Chaffetz, Turtleman, House, Senate, having a role is just a big conflicts ball of yarn.
Any respectable attorney, much less an AG, would have recused himself from any investigations.
When i was involved in anything with conflicts, i wrote a letter immediately, so I could take the lead before someone else brought it up, so there would not be a perception that I would have done it. Everone has conflicts occasionally, that's how it is when you are active in the world, locally, state, or nationally, but you recuse yourself promptly.
All good attorneys do that. This is the Chief Attorney of the US. Egregious. Someone in Alabama, where he is licensed, should file a bar complaint. Well, I guess it might be a waste of paper in Alabama

(269 posts)There will be no Independent investigation if Chump chooses the investigator. I seriously doubt Bill Clinton chose Ken Starr

(25,167 posts)Is it really up to Trump to choose? I wouldn't let him choose. Doesn't seem right. Nice way to get this swept under the rug if they let Trump choose.

(30,613 posts)In the aftermath of the disgraceful Ken Starr affair (which of course was Gangrene's doing), Congress changed the law to empower solely the AG to appoint a Special Counsel. This means Jeff Sessions holds the keys to the Republic in his shit-stained hands.

Stage Three: "Special Counsel" (1999-Present)
Current U.S. practice is governed by the Code of Federal Regulations (CFR), Chapter 6. The CFR eliminates the judicial "Special Division" provided for by the EGA, the concept of "covered persons" and the opportunity for Congress to request that an independent counsel be appointed. In general, it provides the AG much wider discretion in deciding whether to appoint an independent prosecutor and gives the AG much greater influence over the investigation than the EGA. The main provisions of the CFR relating to the appointment of a Special Counsel are the following:
(a) Grounds for Appointing a Special Counsel
Section 600.1 of the CFR provides that the AG will appoint a Special Counsel (SC] when the AG determines that criminal investigation is warranted and that (a)investigation by the Department of Justice would present a conflict of interest or "other extraordinary circumstance" and that "under the circumstances it would be in the public interest to appoint and outside Special Counsel." The AG's decision is unreviewable.
(b)Alternatives Available to AG
Section 600.2 provides that, when matters are brought to the attention of the AG indicating that appointment of a special counsel may be appropriate, the AG may:
(a) appoint a Special Counsel;
(b) direct that a preliminary investigation be conducted in order to better inform
the AG's decision;
(c) conclude that under the circumstances the public interest would not be
served by appointment of a special counsel and that the matter can be
handled byIf the AG reaches this conclusion, the AG may direct that
appropriate steps be taken to mitigate the conflict, such as recusal of
particular officials.

For now, we have press investigations..so be it...and that, for now, will have to do..we know they are going to try and sweep this away...
