Gorsuch Declines To Discuss Emoluments Clause

Source: Talking Points Memo

By ESME CRIBB Published MARCH 22, 2017, 11:21 AM EDT

Supreme Court nominee Neil Gorsuch on Wednesday declined to discuss the Emoluments Clause of the U.S. Constitution, which President Donald Trump has been accused of violating.

"What is the purpose of the Emoluments Clause?" Sen. Patrick Leahy (D-VT) asked Gorsuch during his Senate confirmation hearing.

"The Emoluments Clause, Senator, is not a clause that had attracted a lot of attention until recently," Gorsuch said. "Among other things, it prohibits members of the government of this country from taking emoluments, gifts from foreign agents."

The liberal watchdog group Citizens for Responsibility and Ethics in Washington filed a lawsuit in January accusing Trump of violating the Emoluments Clause by leasing space to state-owned companies and obtaining loans from foreign state-owned banks.

He's just a more polished Drumpf, showing his disdain yesterday for women when he got all haughty with Klobachar. He never treated any of the mens' questions the way he did hers. He's also shown 100% fealty to the rich in his decisions and votes and no care at all for the working people. We can't have a younger Scalia on the court! #RESIST

Whether he acquired those businesses before or after his election, he still can't accept money he is getting now from foreign customers of his businesses.

The Paula Jones lawsuit established a precedent that a sitting president can be sued. The plaintiff may have to be an individual personally hurt, so as with Ivanka, http://www.democraticunderground.com/10141734622 many hotel owner can sue for unfair competition. Heck, Tiffany can sue for reduced revenue because the proximity to the Tower and all the extra security.
