Roy Moore: Impeach Judge Who Blocked Trump's 'Transgenderism' Order
Source: Talking Points Memo

Alabama Republican Senate candidate Roy Moore said Monday night that the federal judge who issued an injunction against President Donald Trumps ban on transgender people serving in the military should be impeached.
The decision by U.S. District Judge Colleen Kollar-Kotelly, Moore said in a statement shared with TPM, is absolutely ridiculous and is a perfect example of the outlandish doctrine of judicial supremacy whereby judges exalt themselves over the Constitution they are sworn to uphold. (Read Moores full statement below.) Kollar-Kotelly granted a preliminary injunction Monday to stop Trumps policy which began with a tweet from going into immediate effect.
Moore said the American Psychiatric Association considered, in his words, transgenderism to be a mental disorder until 2013. (The APAs board of trustees approved the removal of gender identity disorder from its Diagnostic and Statistical Manual of Mental Disorders in late 2012, replacing it with gender dysphoria.)
And only in 2016 did the Obama administration attempt to impose that delusion upon our fighting forces, Moore continued. To say that President Trump cannot prohibit transgenderism in the military is a clear example of judicial activism. Even the United States Supreme Court has never declared transgenderism to be a right under the Constitution.

The decision of a federal judge in the District of Columbia enjoining President Trumps executive order on transgenderism in the military is absolutely ridiculous and is a perfect example of the outlandish doctrine of judicial supremacy whereby judges exalt themselves over the Constitution they are sworn to uphold. As recently as 2013, the American Psychiatric Association considered transgenderism to be a mental disorder. And only in 2016 did the Obama administration attempt to impose that delusion upon our fighting forces. To say that President Trump cannot prohibit transgenderism in the military is a clear example of judicial activism. Even the United States Supreme Court has never declared transgenderism to be a right under the Constitution.
Judge Kollar-Kotelly should be impeached by the House of Representatives for unlawful usurpation of power (Article II, § 4) and lack of good behavior (Article III, § 1), and referred to the Senate for a vote on removal. Not only has she placed herself above the Constitution in finding such a nonexistent right, but she has also interfered with the powers of the President as Commander in Chief of the armed forces under Article II, § 2, of the Constitution.
Unless we return to faithful obedience to the Constitution and the separation of powers set out therein, our form of government and our liberties will be in dire jeopardy. Congress should not turn a deaf ear to this flagrant usurpation of executive authority.

(3,282 posts)That is an unusually explicit effort to make sure that LGBTQ+ people know that they do not have a right to be visible, to be open, or basically to even exist in the public space. Normally it's just a dog whistle, but this statement is 100% "No. Trans people do not have the right to *exist* in the public space." Take a close look at how he worded that second part there, that "transgenderism" is not a right under the Constitution.
And Moore wants to complain about this judge being a radical activist judge, when Moore himself has been removed from office TWICE because of his radical activism. Once in placing the Ten Commandments in a courthouse, and one after ordering Alabama judges to to disobey the SCOTUS ruling on same-sex marriage. Does anyone remember this?:
And here is the list of charges after his 2016 debacle:
Violation of the Alabama Canon of Judicial Ethics, for demonstrated unwillingness to follow clear law.
Violation of the Alabama Canon of Judicial Ethics, for abuse of administrative authority.
Violation of the Alabama Canon of Judicial Ethics, for substituting his judgement for the judgement of the entire Alabama Supreme Court, including failure to abstain from public comment about a pending proceeding in his own court.
Violation of the Alabama Canon of Judicial Ethics, for interference with legal process and remedies in the United States District Court and/or Alabama Supreme Court related to proceedings in which Alabama probate judges were involved.
Violation of the Alabama Canon of Judicial Ethics, for failure to recuse himself from pending proceedings in the Alabama Supreme Court after making public comment and placing his impartiality into question.
Roy is the very picture of a radical right-wing activist judge, teeming with impartiality and "judicial supremacy" that is not just tinged, but entirely coloured by his religious bigotry, a large target of which is the LGBTQ+ population.

(50,556 posts)She's the presiding judge in "ACLU v. Trump and Pence."
In March 2016, she allowed the chief of police of Washington, DC, to continue denying concealed carry permits.
She ordered Cheney and the National Archives to preserve all Cheney's official records.

(2,559 posts)The downside is that if Moore loses, Trump (or Pence) will probably appoint him to the Supreme Court...
