Cohen's Lawyer Sends Stormy Daniels Cease And Desist After CBS Interview

A lawyer representing Michael Cohen, President Donald Trumps longtime personal attorney, sent a cease and desist letter to the lawyer for Stephanie Clifford, the porn actress who uses the name Stormy Daniels, on Sunday night after Clifford appeared on CBS 60 Minutes to discuss her alleged affair with Trump.
Cohens lawyer, Brent Blakely, charged that Clifford made false and defamatory statements during the 60 Minutes interview, specifically when she claimed that she was threatened in a Las Vegas parking lot in 2011 not to discuss her relationship with Trump.
Blakely denied that Cohen has anything to do with the threat.
In truth, Mr. Cohen had absolutely nothing whatsoever to do with any such person or incident, and does not even believe that any such person exists, or that such incident ever occurred, Blakely wrote. You and your clients false statements about Mr. Cohen accuse him of criminal conduct and constitute, among other claims, libel per se and intentional infliction of emotional distress. It would appear that your statements of alleged criminal conduct are being made to obtain an advantage in a civil dispute, which is also improper.

(15,265 posts)She said she could ID him if she ever saw him again, but she didn't know who it was or who sent him. Cooper pressed her whether the person was sent from Cohen. IIRC, she said she assumed he was, but she did not know for sure.
So, this letter basically affirms the thug was sent by Cohen.

(10,122 posts)1. He has a NDA with Stormy that he was very involved with - to the extent of giving her $130,000 of his own money to keep her mouth shut

2. "... But we did receive a letter from Mr. Trump's attorney Charles Harder, who asked that we show on camera and read on air one of the statements Stormy Daniels signed in January, denying reports she'd had an affair with Mr. Trump. It says, in part:
"My involvement with Donald Trump was limited to a few public appearances and nothing more."
Those two things are difficult to coexist. You do not need to pay $130,000 to someone if their "... involvement with Donald Trump was limited to a few public appearances and nothing more."
And you do not need to get a signed statement to that effect when you can just brush it off.
Stormy signed that statement more than a year later without any further compensation. She had to be under some kind of pressure or threat for those two events to coexist. By all appearances so far, Cohen intimidated Stormy Daniels to lie - not a good thing for a lawyer to do in terms of ethical conduct.
Stormy Daniels lawyer ought to be making a complaint to the California bar (or wherever the jurisdiction is) against Mr Cohen and this lawyer who originally represented her and Karen McDougal because if that bar finds a third women with a NDA with these two lawyers involved, it's game over for Cohen, Trump and that original lawyer. They'll lose their ability to practice law and Trump is in deep trouble beyond the lawsuits that will result.

So it gets down to "Who 'ya gonna' believe?"

(81,125 posts)Thanks for the extensive legwork! You dug up a lot!
One thing I never hear often enough, when the whining and yowling and double-talking and excuse-making starts, is how NOT ONE of these things is happening in a vacuum. NOT ONE of these things qualifies as an oopsie or a mulligan or a but-hes-new-at-this,-give-him-time OR a its-just-a-coincidence thing!
Seriously! How-the-hell many coincidences must there be before some of these dingdongs finally start waking up? How many hot-n-cold-running-Russians must there be, coming out of every doggone faucet all over that campaign and that White House before the stench finally becomes too unavoidable?
Good Grief, if this were President Obama or Hillary, CRIMINY! Either of them would have been tried, convicted, tortured, executed, buried, and then dug back up so it could all start up again a second time!

(115,606 posts)She never said or even implied that it was Cohen or someone acting for him who threatened her - it was just some guy in a parking lot. She said she didn't know who he was but that she would recognize him if she saw him again. Presumably she has seen Cohen again and never said it was him. But by firing off this letter Cohen's lawyer seems to be acknowledging that Cohen somehow was involved. Dumb move, but what we've come to expect from this crowd.
