A video has gone viral of a police officer punching and putting a woman in a headlock Saturday in front of children and dozens of other people at a New Jersey beach. The woman, identified as 20-year-old Emily Weinman, confirmed the incident in a lengthy Facebook post.
She said police were checking for underage drinkers Saturday and approached her. She allegedly passed a breathalyzer test but then asked the cops if they had something better to do than stop people from underage drinking on the beach. Thats when things went south.
After refusing to give her name, Weinman said the cop told her he was putting her under arrest. He told me hes arresting me and started coming towards me to put handcuffs on me. I cautiously was backing up from him (facing him) and yelled for my daughters father. (he was playing in the ocean with our daughter at the time), Weinman wrote on Facebook. I tripped and fell and the cop tackled me to the ground and smashed my head into the sand. At that point I blacked out and fought any way possible trying to get up and push him off me. Thats when he head locked me me by his arm around my neck, punched on me in my head and then he head locked me again but this time choking me, I was gasping for [air].

(17,781 posts)but I'm not so sure about inaccurate. Every year it gets harder and harder to separate the sheep from the goats. This is becoming so common you can't tell who are the good cops and who aren't. It's to the point of treating them all with suspicion unless you know them personally.

(3,171 posts)Imagine how many tens of thousands of cop/citizen interactions take place every day across America. Now consider that in the vast, vast majority of those interactions, both parties go their separate ways without injury, and in some cases better for the interaction.
So yes, that statement was both inflammatory and inaccurate, as well as wrongheaded. If someone said to you, "A black guy robbed me once so now I'm suspicious of all black people," you'd be outraged, and rightly so. Both attitudes are prejudicial and thoughtless, driven by emotion rather than reason.
Every time a cop kills someone, there's a large portion of DU that condemns the cop, with no regard for evidence or reality. It's just a knee-jerk reaction of "Cops bad!" Hell, even after evidence totally exonerates an officer, people still refuse to acknowledge it. It's really saddening to see attitudes like these in a community that pats itself on the back for being "reality based."

This is not the first time we have read about cops punching, smacking and body slamming women around. When did this become proper behavior for LEOs ? Last week, we read that a cop had punched a young (obviously) pregnant woman in the stomach, sending her to the ER. She did not commit any crime either.
I am getting really angry reading of all these assaults on women by cops. What is wrong with these men ? I know that I would not stand idly by while some cop needlessly physically assaulted a woman, especially a pregnant one. Arrest me, but I will not watch some cop wail on a defenseless woman who has done nothing wrong.

(3,171 posts)All I said was that these incidents, as troubling and outrageous as they are, are not the norm. No one live streams it when a cop helps move their stalled car out of traffic. No one shouts from the rooftops about the nice officer who helped them. The negative incidents get all the bandwidth, and it breeds the perception that cops just can't wait to shoot some black people, when most cops will never even draw their service weapon (and they hope they'll never have to).
All the things that people around here say about cops just plays right into the Republicans' hands, because it lets them say to cops, "Look at the things these liberals are saying about you guys! Support us, we're the party in favor of law and order!"
Again, the reactions I see here every time there's a story about cops doing something wrong... they aren't rational reactions, which is hilarious given how often I see comments about the other side reacting from fear, or hatred, or whatever, instead of reacting rationally.
Even when physical, forensic evidence exonerates an officer, people ignore it because it doesn't fit with their preferred narrative. Ignoring inconvenient facts... when did that become acceptable?

That's the norm. That's the reality. Even the good cops are bottom-of-the-barrell rotten if their best defense is "Hey, that was my partner, not me!"

(3,171 posts)There are thousands, perhaps tens of thousands of police/citizen encounters every day, and the vast majority of those end with no one injured, and sometimes with both parties the better for the interaction. Do you think it'll gain traction in the press if a cop helps an old lady push her stalled car out of traffic? Probably not. Or remember when that cop used his own money to buy shoes for a homeless guy on a cold night? Judging by your response, you probably don't, if you even read the story to begin with.
But if you want to continue to cling to a view that's incompatible with simple logic and common sense, go nuts, have fun with it. I'll be over here in the real world where rare incidents aren't run through the Magic Hyperbole Machine until they're representative of all cops everywhere.

And it plays right into the GOP's narrative that the left is against law and order. It's stupid and irrational, but I see it play out on this forum every time an incident takes place.

(3,171 posts)After ascertaining that no underage drinking was going on, he had no reason to ask her for her name, let alone anything else. The only time a New Jersey cop can demand someone's name is if that someone is being arrested, which requires probable cause. No evidence of underage drinking, no probable cause.
This cop just wanted to throw his weight around and be a bully. He's gonna get fried when this goes to court. If the local government attorneys are any kind of smart, they should reach out to her with a nice fat settlement and fire the cop in question as part of that settlement.
I generally give cops the benefit of the doubt unless and until evidence proves their wrongdoing, but this guy has no business being a mall security guard, let alone a cop. Imagine what he might have done if the lady's fella had tried to intervene!

(3,171 posts)It definitely explains why this meathead didn't know that he had no cause to demand this young lady's name. I expect future Class 2 officers might receive better training, since that's far cheaper than the settlement this incident will generate.

The issue here is police over-reaction to people "mouthing off" at them. That is something that shouldn't trigger arrest. If she was found to not have been in violation of anything, then he should have walked away and let her curse and yell or whatever, with the assumption that she would eventually settle down. "You" (the cop) DIFFUSE by being the adult and walking away.

(3,171 posts)That belief that cops just can't wait to shoot a black person. How many black people interacted with a cop on this same day and didn't get shot, do you think? I'm willing to bet it's a lot.
Washington State University conducted a study where they sent officers into simulated incidents involving unarmed suspects. The results showed they were actually less likely to use deadly force against unarmed black suspects.
Furthermore, in scenarios with armed suspects of both races, officers hesitated to make the shot when facing a black suspect, to the tune of around 200 milliseconds, according to the study.
So in a study where all other factors were controlled, these cops were overall less likely to use lethal force against black subjects.
Regarding this incident, you're absolutely right, if she got mouthy, he should have given her a little salute, wished her a good day, and gone on his merry way. He decided to throw his weight around, and I hope he suffers the consequences of his stupidity.

Here's my answer - Thank goodness for "social media" because slowly the "disbelief" and "denial" can be chipped away as more and more videos DO get posted. And regarding this -
The "officers" used were all from the Spokane PD (Spokane with 2.3% black population), where "Washington State University", a school that is located in a town (Pullman, WA) that has a black population of 2.6%, is in a state that has a black population of 4.1%.
I.e., blacks are not at "threat" level in these near all-white enclaves.
Wake me when someone does a "study" in a locale that has 20 or more % black/minority population and then establish how THOSE cops will react. The actual statistics in the big cities with large minority populations tell a different story.

(3,171 posts)They controlled for all other factors in the study [not the "study"], with race being the sole factor in the shoot/don't shoot simulations. I don't think the local black population is relevant to how officers [not the "officers"] react in simulated scenarios where they're forced to make the same sort of snap decision they make in the field.
The fact that you don't like the results of the study because it undermines your worldview is your problem. I referred to a study that got concrete results. Your attempt at hand-waving away those results comes across as kind of silly, honestly.

My "worldview" is what I see and experience and read about as reality as a middle-aged black woman, not some textbook "simulation" which is obviously never going to replicate any type of real life scenario on a city street. What a silly argument to try to make and that is why this type of nonsense continues.

I.e., trying to report what LEO may or may not do with no actual human in front of them to shoot but what they actually DID when confronting an actual living breathing individual or individuals.
These are FACTS (actual "data" of what has transpired, with the main limitation being it is missing police-generated homicides that were eventually found to NOT be "justifiable" and were thus not included in the FBI's database because there were internal investigations involved, meaning the final FBI minority kill stats are most likely even higher) -
The victims: overwhelmingly male, heavily young, disproportionately black
The justifiable homicide victims of 2012 were overwhelmingly male the FBI's records included 11 women and 415 men. They were also, as are most people that interact with the criminal justice system, disproportionately black. Black Americans make up 13 percent of the US population, but the FBI's data shows that 32 percent of the felons killed by officers in 2012 where black. Fifty-two percent were white, and 12 percent were Hispanic.

One reason the FBI's data is incomplete, of course, is that not all killings by police are "justifiable" even under the FBI's loose definition, which includes any death of someone who'd committed a felony. That said, experts believe that local police departments tend to write up reports for justifiable homicides immediately after the incident, and submit those every month they don't wait for a formal officer-involved shooting investigation to determine whether the victim was really committing a felony or not. In the meantime, the FBI trusts the agency when it says the homicide victim was a felon. So there may be homicides in the FBI's data for justifiable homicides that turned out not to be.

At that point, he had no probable cause to continue to investigate, and under New Jersey law, no cause to ask her to identify herself. Everything that came after was a direct result of his incompetence. No charges against her will stick unless there's video evidence showing she was the aggressor.
I'm sure her attorney is shopping for a new yacht at the moment, because this is going to be a bigass settlement.

It was one of his racist 'dog whistles' to his disgustingly racist deplorable base....it's always been this way in ameriKKKa. To treat an unarmed and crippled person this way, "put your hands up like I'm going to shoot you". A lucky person not to have been shot, but I think they just wanted to inflict pain on that person for not allowing his racist mouth to intimidate. Protect and serve, everyone but brown skinned peoples. Always been this way and now white people are getting this treatment. This country is really fucked.

IT WILL NOT change my opinion of the many, many racist white cops openly killing, by rope and gun, quite a few unarmed men women and children and walking free to do these types of crimes again by a racist system, governed by a racist administration led by a racist potus. A bunch of thugs and hoodlums are hired to be police officers and the Good Guys on the force remain quiet while the thugs and hoodlums attack people on the street or beach. I'm sure they don't agree with this behavior and they need to stand up against it.
