In a normal world with a real President that would be the case. These days - not so much.

A lot of people are thrown by the dicta in the Burdick decision. It was a non-essential statement made in a specific case of the government trying to force a pardon on an unwilling recipient in order to compel testimony (by eliminating 5th amendment protections).

It clearly doesn't apply where the pardon is granted on the grounds that the law was wrong or the jury was wrong. If someone is wrongly imprisoned and later exonerated with dna evidence, why on earth should they have to admit guilt in order to get out of prison?

Trump offers pardon to conservative pundit Dinesh D’Souza for campaign finance violations

by John Wagner May 31 at 9:38 AM

President Trump announced Thursday that he would offer a full pardon to conservative author and documentary filmmaker Dinesh D’Souza, who pleaded guilty in 2014 to violating federal campaign finance laws.

D’Souza was indicted on charges that he illegally used straw donors to contribute to a Republican Senate candidate in New York in 2012. He was sentenced to five years of probation, including eight months living under supervision in a “community confinement center” in San Diego, and a $30,000 fine.

Prosecutors said he had other individuals donate money to Republican Wendy Long, a Republican challenging Sen. Kirsten Gillibrand (D-N.Y.) in 2012, under the agreement that he would reimburse them for the donations.

Last year, D’Souza claimed he was targeted by the Obama administration for “political” reasons. “Will be giving a Full Pardon to Dinesh D’Souza today,” Trump wrote on Twitter on Thursday. “He was treated very unfairly by our government!”

18. Dinesh D'Souza Flashback:
Thu May 31, 2018, 10:35 AM
May 2018
The firebrand’s latest offense against general human decency came Tuesday afternoon when he responded to a photograph of Florida school-shooting survivors crying after the state’s legislature voted down an assault-weapons ban.

“Worst news since their parents told them to get summer jobs,” he mocked the kids who’d watched 17 people get murdered inside Stoneman Douglas High School just a few days prior—all because he disagreed with their political beliefs.

“Adults 1, kids 0,” he added.

Over the past year, D’Souza has: suggested the Charlottesville white-supremacist rally (which led to the murder of an anti-racism protester) was a “staged event” designed to make the right look bad; shared a meme calling former President Barack Obama a “gay Muslim” and suggesting Michelle Obama is a man; started a conspiracy theory that the media covered up Las Vegas gunman Stephen Paddock’s background as an anti-Trump activist (he wasn’t); used a photo of a grieving military widow—despite her protests—to attack football players kneeling during the national anthem; and defended Adolf Hitler, who sent thousands of gay people to death camps, as being “NOT anti-gay.”

In early 2017, D’Souza called civil-rights icon Rosa Parks an “OVERRATED DEMOCRAT” whose historic 1955 protest against segregated buses is “absurdly inflated” by the left. National Review’s top digital editor Charles C.W. Cooke fired back: “Not only is this is incorrect, it's an attitude that would never be struck about a soldier on, say, Veterans Day.” He added: “[E]ven if Parks was a minor player (she wasn't), she'd still deserve to be lionized.”
