Appeals Court orders collective bargaining proposal onto ballot

Lansing — The Michigan Court of Appeals has ordered the Board of State Canvassers to place a collective bargaining rights proposal on the Nov. 6 election ballot.

The Supreme Court ordered the lower court to decide the issue by Monday to have time to get the issue on the ballot.

The Appeals Court panel cited an earlier Court of Appeals decision in a case involving Citizens for Protection of Marriage ballot proposal that determined the board's legal duty was to certify if the petition was in proper legal form with sufficient signatures.

Monday's ruling said the Board of State Canvassers exceeded its authority by failing to certify the petition.

The Michigan Court of Appeals rejected this afternoon a challenge to a ballot proposal aimed at enshrining collective bargaining rights in the state constitution.

The three-judge panel divided 2-1 on a key question in the case, whether its backers, a coalition of labor groups, had provided adequate notice to petition signers and prospective voters how the proposal would affect other constitutional provisions.

Rich Studley, president of the Michigan Chamber of Commerce, a part of a coalition of business and taxpayer groups which filed the challenge, said moments after it was released it was "certain to be appealed" to the Michigan Supreme Court.

The court is likely to have a very busy calendar of election cases in the next two weeks, as elections officials race to finalize the state ballot by Sept. 7.

Chamber of Commerce running radio ads claiming "Da evil Union Bosses are trying to destroy the middle class, they only want guaranteed pensions for gubmint workers (how dare they), taxpayers will get stuck with the bill, blah, blah, blah..."
