A redistricting plan signed by Texas Gov. Rick Perry (R) intentionally discriminated against Hispanic voters, a three-judge panel unanimously ruled Tuesday. The judges found that seats belonging to white incumbent members of Congress were protected under the plan while districts belonging to incumbent minorities were targeted for changes.
The court was persuaded by the totality of the evidence that the plan was enacted with discriminatory intent, according to the ruling. There was sufficient evidence to conclude that the Congressional Plan was motivated, at least in part, by discriminatory intent, the court found.
All three judges said they were overwhelmed with the amount of evidence showing the law was intentionally discriminatory, writing in a footnote that parties have provided more evidence of discriminatory intent than we have space, or need, to address here.
All three redistricting plans for Texas congressional delegation, its state House of Representatives and the state Senate were blocked by the federal court. The Supreme Court had earlier ruled that interim maps drawn by a federal court were invalid.

Texas state Attorney General Greg Abbott, a Republican, said his office would appeal the decision. "Today's decision extends the Voting Rights Act beyond the limits intended by Congress and beyond the boundaries imposed by the Constitution," said Abbott, in a statement. "The Attorney General's Office will continue defending the maps enacted by the Texas Legislature and will immediately take steps to appeal this flawed decision to the U.S. Supreme Court."
The court ruled that, even though Texas gained four congressional seats in redistricting, it did not gain any Hispanic "ability districts," seats where Hispanic voters have the power in numbers to elect a preferred candidate. What's more, the court found "discriminatory purpose" in the plan, writing that the maps were crafted with the purpose of diluting minority voting power.
"The only explanation Texas offers for this pattern is 'coincidence,'" the court ruled. "But if this was coincidence, it was a striking one indeed. It is difficult to believe that pure chance would lead to such results." The judges also noted that they did not even need to consider the full body of evidence presented before them to conclude that Texas acted with discriminatory intent in crafting the maps.

This year's elections are proceeding under different, interim maps developed by a separate federal court in San Antonio. Those interim maps are not affected by the decision. But unless Texas is successful in appealing the court's decision, the state will be forced to once again redraw their election maps prior to the 2014 elections.
The court noted that it is the fourth time in as many decennial redistricting cycles that Texas has been taken to court over their new maps -- and they have lost in court each time.

Romney, who ran to the right of the rest of the Republican presidential field on the issue of immigration reform, is viewed favorably by just 27 percent of Hispanic voters.
As we have seen in recent months and confirm in this survey, Romney has many challenges in making significant inroads with the Latino vote, said Gabriel Sanchez, research director at Latino Decisions.
Ayres said Republicans need to get closer to the 44 percent of the Latino vote that George W. Bush received in 2004 than Romneys current standing.
Republicans, if they are going to remain competitive nationally, are going to have to do better among non-white voters, he said, including Asian American voters among the GOPs challenges.

One things for sure, they're not going to get Latino support with stunts like this one.
They seem to think since someone has non-white skin they're too stupid to figure out they're being discriminated against by the Republicans. Polling shows otherwise.

(582 posts)The ability to rewrite the districts was based on a real clever ruse. Two men presented themselves to two different state representative election committees in district that never ran Republicans. They ran as Democrats and won, then promptly upon arrival in Austin declared themselves Republicans, giving the House a bullet proof majority. And you thought the Republicans played dirty on the national scene. Couldn't make up my mind to tip my hat to clever opponents, or throw up.

(7,402 posts)This just shows how difficult it is to end State run racism. Of course Republicans favor ending the Voting Rights Act as no longer being necessary. Wrong, it is needed just as much now as it was back in 1965 -- as this case clearly shows.

(11,833 posts)In my opinion, republican efforts toward voter suppression is the biggest USA news story of the year. I'm glad people are volunteering as registrars. And glad federal courts are knocking down these blatant attempts to deny people's right to vote.

(10,494 posts)of when the census comes out. Several Dems flew from the state and Rethugs put out a man-hunt looking for them. Delay's re-districting set us Dems back awhile. The Texas Courts said there was no gerrymandering when you had a District like mine in Southeast Texas where it stretched for over 120 miles and at one point was only 15 feet wide. It split a really large group of wealthy subdivisions North of Houston, went down to the coast and then over to Beaumont, Tx. (population 115,000/50% black) and went right through the middle to break up our Democratic district. Nick Lampson was our U.S. Congressman. He later moved to Tom Delays district and beat his ass after the arrest even though Delays district was heavily Repug. He lasted one term there. He is running again to be our Congressman do if you can afford to, give this Democratic hero some help. Nick is a former school teacher and a great person! Kick that ASS!
