Trump announces Kavanaugh replacement for DC circuit court

President Trump announced Tuesday he is nominating Neomi Rao to fill Supreme Court Justice Brett Kavanaugh’s vacant seat on the US Court of Appeals for the D.C. Circuit.

Rao currently serves as the administrator of the Office of Information and Regulatory Affairs (OIRA.

She is a vocal advocate of Trump’s efforts to slash government regulations, crediting the reductions with stimulating job growth.

“I think the reform efforts are part of what has stimulated economic growth and job creation and promoted technological innovation. And from my perspective, our reform efforts have really focused on promoting the rule of law and emphasized the productivity and potential of the American people that’s possible when you get rid of unnecessary economic burdens,” Rao said at an American Bar Association conference earlier this month.

In the fall of 2013, Harry Reid used the nuclear option in order to allow Obama to finally fill the vacancies on that specific court (among others).

Obama also tilted the partisan makeup of circuit courts. Nine of the country’s 13 appeals courts now have majority Democratic appointees, compared with just one when he took office in 2009.


We may have been fucked at the top court but there is a bit of a firewall before anything would reach there and the Circuits are where most cases end (there is no way that the SCOTUS can hear thousands and thousands of cases each term).

There is no way the justices have time to winnow through the tens of thousands of writs of certiorari, so it is the clerks -- most just out of law school -- who decide which cases proceed to the next level of the selection process.
