White House: Trump has 'broad discretion' to regulate journalists' access

The White House said in response to a lawsuit by CNN that correspondent Jim Acosta's press pass was revoked because of conduct that 'disrupts press events.'

The White House on Wednesday said President Donald Trump has "broad discretion" to regulate journalists' access, arguing in its formal response to a lawsuit by CNN that correspondent Jim Acosta's press pass was revoked because of conduct that "disrupts press events."

"The President and White House possess the same broad discretion to regulate access to the White House for journalists (and other members of the public) that they possess to select which journalists receive interviews, or which journalists they acknowledge at press conferences," the White House said in a legal filing Wednesday.

"No journalist has a First Amendment right to enter the White House," the White House said.

CNN filed a lawsuit Tuesday asking a judge to restore Acosta's credentials and declare that the administration's decision to yank them last week was unconstitutional. The White House pulled the reporter's access after he repeatedly tried to ask Trump questions at a press conference, even after the president tried to dismiss him, and briefly refused to let a White House aide pull a microphone out of his hand.

He couldn't have done more to awaken the nation to illegal attempts to silence the mainstay of democracy. The free press. As Jefferson said if he had to chose between a government and no free press and no government and a free press that he would without question chose the latter. There is nothing more characteristic of a dictatorship than their determination to silence the free press. It is paramount for the operation of a totalitarian government. Only the most partisan of today' political hacks are smart enough not to attempt to justify what Trump has done.

by a Democratic president in 2021 who will cite this precedent.

FOXNews's amicus brief is one thing, but Trump won't read or see it. They ought to be hammering him on air, just out of self-preservation.

We saw this with the muslim ban. The lower courts were more than willing to consider WHY the ban was instituted. The SC seemed more concerned with whether the authority existed, DESPITE, the motivation. Same thing here. Does the White House have the authority to control access. This SC will probably say "yes". They won't care if it is to undermine the 1st amendment.

Thirteen news organizations including Fox News, NBC and POLITICO announced Wednesday they would file amicus briefs supporting CNN's lawsuit.

"It is imperative that independent journalists have access to the President and his activities, and that journalists are not barred for arbitrary reasons. Our news organizations support the fundamental constitutional right to question this President, or any President," a joint statement from the news organizations said.

The judge presiding over the case, Timothy Kelly, is a Trump appointee and set a hearing for Wednesday afternoon.

.. would they have broad discretion over other access to Executive branch functions - regulatory agencies, etc.

Fox News is supporting CNN's lawsuit against the Trump administration over the White House's revocation of Jim Acosta's press pass and plans to file an amicus brief in the case, according to a statement from the network's president Jay Wallace.

"FOX News supports CNN in its legal effort to regain its White House reporter’s press credential. We intend to file an amicus brief with the U.S. District Court. Secret Service passes for working White House journalists should never be weaponized. While we don’t condone the growing antagonistic tone by both the President and the press at recent media avails, we do support a free press, access and open exchanges for the American people."

Twelve other news organizations also announced they would be joining Fox in filing an amicus brief in support of CNN.
