No jail time for Baylor fraternity president accused of rape

WACO, Texas (AP) — A Texas judge on Monday accepted a plea bargain allowing a former Baylor University fraternity president accused of rape to avoid serving jail time, prompting outrage from the former Baylor student who filed the complaint and her parents.

Judge Ralph Strother accepted the plea deal for Jacob Walter Anderson, who was indicted on sexual assault charges and pleaded no contest to a lesser charge of unlawful restraint. A no contest plea means a defendant does not admit guilt, but will offer no defense.

The deal from prosecutors allowed Anderson to receive deferred probation. The ex-Phi Delta Theta president agrees to seek counseling and pay a $400 fine. Anderson will not be forced to register as a sex offender.

The woman who accused Anderson said she was devastated by the judge's decision and described the county's justice system as "severely broken." An online petition had been created to oppose the plea agreement, which the woman said more than 85,000 people have signed.

After he tried to protect the football players who gang raped a girl! ...If my memory serves me correctly.

Not sure if this incident happen under his watch I need to read about it.

The victim learned of the lesser plea via an email from LaBorde, which in part reads: “I’ve accepted an offer on Jacob Anderson. It’s for probation on the charge of felony unlawful restraint not sexual assault – therefore, he will not have to register as a sex offender. I realize this is not the outcome we had hoped for or that I had originally offered, but I tried a very similar case to this one last month, and lost.

“In light of the similarities between the cases, it’s my opinion it would be worse to try Anderson and lose and have the entire matter wiped from his criminal history than to accept this plea offer,” LaBorde wrote.

"Let us remind everyone that our oath is to seek justice. In pursuit of that ideal, we must evaluate each case alone on its own merit. Early in this case, law enforcement believed that the victim may have been drugged and this belief has been widely disseminated in the media; however, the evidence did not support that theory," he said.

The defendant is accused of rape. Denunciations on DU don't put anyone in prison, though. The prosecutor had to weigh the danger that, if he took the case to trial, the defendant would be acquitted on all charges and would suffer no penalty whatsoever. Whether the plea bargain was a fair one depends in part on the strength of each side's evidence.

The prosecutor also had to take account of the predisposition of the jury pool. In that county, there might be quite a few prospective jurors who would accept defense arguments about what the woman was wearing or the like.

but it it were my daughter, jail would be the least of his concerns. Growing eyes in the back of his head his primary objective.

She's just over eight months old so it's a going to be a while but her Uncle 47 is going to look out for her.

...that the District Attorney in this case also approved of this plea deal. Which likely means the DA had very serious doubts on the probability of securing a conviction at trial. Perhaps there is a problem with witness testimony, or the provable facts are "muddy." District Attorneys rarely agree to lenient plea deals if they think they have a good chance at securing a conviction. They want their "wins".
