Baker in same-sex wedding cake case back in court on transgender bias allegations

The Colorado man who refused to bake a wedding cake for a same-sex couple was back in court this week, this time over his refusal to make a cake celebrating a gender transition.

Less than a month after the Supreme Court issued its June ruling, which handed baker Jack Phillips a partial win, Colorado found that he had again violated the state’s public accommodations laws by refusing to make a cake with blue exterior and pink interior for Autumn Scardina. The state argued that Phillips denied Scardina service because she is transgender.

In his lawsuit in the federal district court in Colorado, Phillips claims the state is bullying him for his religious beliefs.

“The state’s continuing efforts to target Phillips do not just violate the Constitution; they cross the line into bad faith,” his attorneys at Alliance Defending Freedom argued in court documents.

2. This sounds like a very different case from the wedding cake.

From the article, it looks like the cake had a particular color scheme, but no text or whatever saying something about the transition. Had the customers not said what the cake was for, the baker might not have known. If so, this shows clear bias on the part of the baker - he's refusing to make a product not because of the message, but because of something intrinsic to the customer.

As an aside - why would anyone give this person his or her business? He may be a phenomenal baker, but he's also a bigot. There are lots of phenomenal bakers out there who aren't bigots.

I've seen his website. He's good, but there are a LOT of better bakers than he is.

Especially if they requested it with no identifying information. All he'd have to do is give them a plain cake and a plastic tube of lettering icing and it'd be over. But I'm sure this individual's point is to get publicity.

He's being represented by the Alliance Defending Freedom, and this kind of case is their whole reason for existing. They're probably doing it pro bono or at a reduced rate, since they have an ideological dog in this fight.

Don't know that's the case for sure, but it wouldn't surprise me.

I wouldn't be surprised to learn that Alliance Defending Freedom relies on donations from the usual suspects.

In any case, he seems dead set on fighting it out to the bitter end. I guess we'll see what happens.

I don't think there's much in the Bible about transgender folks. There is quite a bit about loving one's neighbor and treating others as one would like to be treated, though...
