Leaked chat logs reveal that Daniel Morley, a school resource officer, recruits for Identity Evropa.
.....................................
Daniel Morley, 31, a school resource officer at L.C. Bird High School in Virginia, holds a side gig as an organizer for Identity Evropa, a group noted for its part in the organizing of the deadly Unite the Right rally in Charlottesville in 2017. The group (also known as the American Identity Movement) tasked Morley with helping new recruits through the application process.
..................................................
Morley been suspended from his job at the high school, and Chesterfield County Police Chief Jeffrey Katz recommended he be fired pending a state-mandated disciplinary process, according to the Richmond Times-Dispatch.
We are concerned and committed to determining if there is any truth to these allegations, Katz said Monday. There is absolutely no place for intolerance or prejudicial behavior in public service, and we will not tolerate affiliations which even remotely lend themselves to predispositions of bias.
Morley ― using the moniker Danimal876 ― had been posting on the white nationalist groups private chat server since at least 2017, according to The Daily Beast. He used that handle on multiple platforms, including the white supremacist forum Stormfront, to espouse racist views and engage with likeminded bigots as far back as 2009.........................

(57,284 posts)doesn't he have the right "to espouse racist views and engage with likeminded bigots" and not as a result of this association be "suspended from his job at the high school...."?
Has he been suspended for his beliefs or for his acts? What were those acts?
I'm asking for a friend:

Yes, this again.

(12,132 posts)I'm not sure he gets to be free from the consequences of espousing them. The school district shouldn't have to give him a platform for recruiting school kids to his dopey, ignorant group.
But I am not a lawyer.
If I ran a business and I found out you supported all those racist views I think I can legally decide you're too stupid to work for me. I guess, depending on the state, I might have to jump though hoops to fire you legally but those are hoops I'd happily jump through.

(9,457 posts)against the government without prosecution. An employer can, in most states, fire people at will. The big exception to that is if the firing infringes on some other right of the individual (like freedom from discrimination based on color or national origin).
Also, certain jobs have higher standards due to their nature. A police officer must demonstrate ability to make arrests without bias. Not only would it be problematic for a jury, it would likely result in white criminals being left on the street putting the public at risk.
A police officer needs public trust to effectively do their job. That can't happen when you're a member of a hate group labeled as an Extremist Group.

If there is an agreement with the Union, then that supersedes everything else.

(26,311 posts)While public employees do have more protection from employer (the government) sanctions due to their speech, a line HAS to be drawn when they say or do things that would show a bias against people they interact with in the course of their job.
Seriously, how could this guy EVER testify in court or write a report about an African American suspect/defendant and not have his hatred brought up? He cant. Furthermore, every case he has ever prosecuted against a Minority Person can and should be brought in to question.
How can this even be a question?

(8,652 posts)Free speech does not protect you in the workplace.
Unions do and Civil Service will, but as a school resource officer, his racist beliefs can put children at risk. As a police officer, he would have to go through psychological evaluations in order to be placed in certain assignments.

(4,066 posts)These groups espouse hate and their speech is hate speech. The courts have ruled on that. It is not protected.

(2,199 posts)There have been several supreme court rulings that have determined that hate speech is protected by the first amendment.
However, the first amendment just means that we can't be arrested, jailed, etc. by the government because of what we say. But, it doesn't mean we are protected from the consequences of our speech by the government either. That means we can be criticized, ridiculed, and even fired. And, if any of those things happen to us, we are still free to repeat the same thing again.

(37,748 posts)but employees (Yes, Virginia... even government employers) often sign a contract which stipulates, among other things, the employer will not tolerate affiliations which even remotely lend themselves to predispositions of intolerance or prejudicial bias, as they reflect poorly upon the business.
There a hundreds of case laws you can reference for precedent.
