Cummings: Ivanka Trump not preserving all official email

WASHINGTON (AP) Ivanka Trump, the presidents daughter and a powerful White House aide, is not preserving all of her official email communications as required by federal law, the chairman of the House Oversight and Reform Committee said on Thursday.
Rep. Elijah Cummings, D-Md., said in a letter that Trumps lawyer, Abbe Lowell, informed the committee late last year that Trump doesnt preserve official emails she receives in her personal account if she doesnt respond to them. Cummings says that appears to violate the Presidential Records Act.
The letter raises the latest concern about the use of private email and messaging applications to conduct official White House business. It also details the use of the messaging application WhatsApp by Trump son-in-law Jared Kushner and of personal email accounts by other former senior White House aides that Cummings says raises additional security and federal records concerns.
The letter says Lowell confirmed that Kushner, Ivanka Trumps husband and a senior White House aide, uses the WhatsApp to conduct official U.S. government business. According to the letter, Lowell said Kushner has used the application to have communications with people outside the United States, though he did not provide the identities of those involved.

(3,483 posts)Why are the Committees always "requesting" documents when they know in advance the respondents will just refuse?
Time is too short too waste on this, can they not eliminate the days and days of stalling and just ISSUE SUBPOENAS the first time? At least those are backed up by judicial enforcement powers.
Courtly Congressional gestures and "reaching across the aisle" for cooperation are things OF THE PAST!

(53,410 posts)Think of it this way. Do you think it would be acceptable or legal if the Republicans threw procedure out and just issued Subpoenas for every single investigation?
Procedure allows the other party time to gather all the requested information. Not complying triggers the escalation of other legal avenues which wouldnt happen if the requested documents are provided when first requested. Theres a reason for every step taken.

I make my living serving subpoenas, summonses, writs, levies, etc for California courts, US District Court, and US Marshal Service.
After service of a subpoena, parties involved are always given plenty of time to gather information. I would assume the same rules apply to Congressional subpoenas, otherwise, what is the magic moment when they are suddenly allowed to subpoena rather than to "request" things? They obviously already have subpoena power.
Maybe there is a statute, don't really know, my gut feeling is that "requests" are just a remnant of more courteous and cooperative times.

Just because they break the law every day doesnt mean they know the laws. Certainly not the laws about governance, national security legal protocol. They are stuck in their ignorant belief that theyre still just citizens.

(16,113 posts)Had a personal email account and then didnt turn over ALL their work related emails. The republicans would be all over it and surely Dems wouldnt try to defend or excuse it, because we believe following the rule of law is more important than political advantage.
