Michael Flynn Changes His Story, Putting Him on Collision Course With Judge

WASHINGTON Michael T. Flynn, the former national security adviser, backed off his planned testimony in a federal case against a former associate, according to court documents unsealed on Tuesday.
Mr. Flynn had previously admitted that he lied on foreign lobbying disclosure forms submitted to the Justice Department but now is blaming his former lawyers, accusing them of filing inaccurate forms without his knowledge. He did not dispute that the filing itself contained false information.
His latest gambit could provoke another dramatic and risky confrontation with the federal judge who delayed sentencing Mr. Flynn last year in a separate case so he could continue to cooperate with the government in the hopes of a lighter punishment. And it was the latest strange turn in a prosecution that should have run its course without much drama after Mr. Flynn pleaded guilty in December 2017 to lying to investigators and agreed to cooperate with the special counsels investigators.
Mr. Flynns lawyers might not care what the judge does if they believe President Trump will pardon his former national security adviser. Mr. Trump has said that Mr. Flynn is a good man who was treated poorly but has not said whether he will pardon him.

Gen Michael Flynn and Gen Benedict Arnold both started out as patriots who served their country well.
Arnold died a traitor in England.
He was not lucky enough to have a Donald Trump on his side.

(15,278 posts)First, the prosecutors were recommending 0, none, nada, zilch, jail time. Why on earth would anyone punch that gift horse in the mouth?
Second, Judge Sullivan specifically asked the prosecutors if Flynn might have committed treason, then required Flynn to co-operate more before passing down sentencing. As Manafort discovered, you can't take back the things in your plea agreement that you already admitted to doing. If Flynn backs out of the co-operation agreement, those crimes can now be considered by the judge. And Sullivan might throw the book at Flynn.
Third, I saw a comment from Flynn's new lawyer about Judge Sullivan not liking "government misconduct". It read to me like she's planning to argue Flynn was somehow entrapped by the FBI, etc, into committing a crime. But, since Sullivan has already seen all the evidence and already got annoyed by Flynn's previous lawyers trying to make a similar claim, that gambit won't work any better this time around and might actually make things worse for Flynn.
Fourth, there were reports that when Flynn decided to flip, a big reason was to save his son from being charged. If Flynn backs out, charging the son might be back on the table.
Last, Trump says a lot and promises a lot but doesn't deliver. If Flynn's banking on a pardon, that's bad strategy because, in the end, Trump doesn't give a hoot about Flynn.

(32,634 posts)... didn't we read that Flynn can name Mike Pence? It's Flynn's testimony that drags Pence into this, otherwise he gets off scot-free. If Flynn rolls the dice, he's risking not only his own freedom, he's risking his son and possibly Pence too. The judges aren't stupid but I wonder about these defense lawyers.
