US-born teen in border custody for 23 days sues government

A mother and her American-born teenage son are suing two US government agencies and speaking out over the inhumane conditions they said he endured while taken into border custody for more than three weeks. Francisco Galicia, 18, from Edinburg, Texas, was released from detention earlier this week after an ordeal in which he said he lost 26 pounds, was kept in a crowded space with 60 others and, for 23 days, wasn’t allowed to call his family or a lawyer, brush his teeth, or get access to a toilet, shower or bed. “Imagine going 23 days without a shower, [proper] sleep, with malnutrition and being forced to sleep on the floor” He was so desperate in the face of the conditions, and unable to communicate with anyone outside, that he almost allowed himself to be deported to Mexico.

Francisco was kept in custody, variously, by US Customs and Border Protection (CBP) and Immigration and Customs Enforcement (Ice) after going through a federal checkpoint 75 miles from the US-Mexico border in Texas, in Falfurrias, while driving to a soccer scouting event.When he presented his state-issued identification, a wallet-sized copy of his birth certificate and his social security card, they were rejected by agents, the family said.

Francisco was freed this week from the South Texas detention complex in Pearsall, near San Antonio, amid pressure from friends and advocates in a campaign that spread via social and mainstream media. His attorney, Claudia Galan, believes Francisco was a victim of racial profiling. “Law enforcement said his birth certificate was fake. That he was not born in the US, The way he was interrogated and harassed, it’s a scare tactic that shouldn’t be allowed in law enforcement at all,” Galan said. Ice did not respond to requests for comment. CBP has asserted that Galicia didn’t claim US citizenship.

“If you’re not white, you can pretty much be deported even if you’re a US citizen,” Galan said.

Umm, wouldn't a reasonable person (not ICE, CBP, Trump supporters) assume that if a person is carrying a copy of their birth certificate they are asserting they are a US citizen?

These people are deplorable.

Everyone should be held accountable for the actions against a documented American citizen. Not just the "boss". I am glad they are suing. I was wondering just last night why they are not filing an immediate lawsuit.

This wasn't anything related to immigration. It was pure racism.

I totally approve of my tax dollars going to this family in reparation for the trauma they've suffered.

Nice juxtaposition against the MAGAbrat's lawsuit being dismissed.

When Trump created this crisis, my child's young Latino friends (all citizens) were so scared, afraid they'd be swept up and deported. As a White Person(TM), I worked at not saying "That couldn't happen to you." I'm glad, because it's worse than they thought, even when you carry your birth certificate & other proofs.

There is an abundance of evidence in his favor. Additionally, does anyone really think that when grabbed by Border Patrol, a person - knowing what they could be facing - would not be screaming, "I AM an American citizen." ??

I live in Whatcom County in Washington State, five miles from the Canadian border. Two weeks ago, as I was returning home from errands, I saw a Border Patrol truck parked off to the side of Mt. Baker Highway. The deputy was standing outside the truck with the front door open, which allowed me to see the logo. I was shocked and no doubt that registered on my face. He jumped into the truck, gunned the engine, flinging gravel all over the place and hit the highway at speed. He raced up on my back bumper like a rocket, coming within 18" of my car. Now, I HATE tailgaters and break-check them whenever they're too close to me. So, I slowed down, waaaaay down, forcing him to slow down as well. In my rearview mirror, I saw him with the hand-held radio mic at his mouth. Calling in my plate, no doubt. I smiled from ear to ear, when he made an immediate left hand turn to go back in the direction from where he came. I have a very unique specialty plate that identifies me as a disabled vet with decoration.

Why Border Patrol was up here, is anyone's guess. The closest crossing is at the Peace Arch, in Blaine (on the coast) and Sumas (miles away from where this took place). Must be all those Canadians desperate to experience what a fascist regime looks like.

I have since discovered that every state that borders Canada has a detachment of BP. Waste of money. Trust me, Canadians are too smart to want to come down here. Well, maybe except for the folks from BC, coming to the COSTCO gas station ! Those poor people are paying about $6+ for gas up there because of the new national carbon tax. Bad news for BCers as they already HAVE a provincial carbon tax of their own.

Claudia Galan, Galicia’s attorney, produced  a notice to appear that DHS issued to Francisco that reads:

“On or about June 27, 2019, you were found at the Falfurrias, Texas, Border Patrol Checkpoint, a distance of more than 25 miles from the United States border with Mexico ... You did not receive the permission of an immigration officer to proceed beyond that 25 mile limit ... At that time, you falsely represented yourself to be a citizen of the United States for the purpose of furthering your entry into the United States.”

I can imagine his family figuring he would be abused and that they could sue for that abuse. He is an American citizen after all.

(I can also imagine someone making money off the "Detention Center Diet" ).
