Occupy protesters have charges thrown out

ROCHESTER, N.Y. — A judge in upstate New York threw out trespassing charges Thursday against 26 Occupy Wall Street supporters for staging late-night protests last fall in a Rochester park.

The demonstrators were among 48 arrested on successive weekends in October and November for violating an 11 p.m. curfew at Washington Square Park. Days later, Mayor Tom Richards shifted direction to let Occupy Rochester protest there round the clock.

About 15 tents now fill up one half of Washington Square, a downtown park about the size of a city block with a Civil War monument at its center.

At a City Court hearing, Judge Teresa Johnson said factual allegations brought by the city's police chief do not sufficiently establish "every element of trespass," which is a misdemeanor.
