Judge bans Detroit police tactics against protesters

DETROIT (AP) — A federal judge late Friday temporarily barred Detroit police from using tear gas, rubber bullets, batons, shields, chokeholds or sound cannons against peaceful Black Lives Matter protesters after a group accused the city for excessive force.

U.S. District Court Judge Laurie Michelson partially granted a temporary restraining order filed Monday by Detroit Will Breathe against the city of Detroit, accusing police of using excessive force to deter protesters from practicing their free speech rights. The order will be in effect for at least 14 days.

“It’s a win but the fight continues,” said Jack Schulz, who filed the lawsuit for Detroit Will Breathe. “For a short period, we know that the police will not be able to use the brutal tactics they have in the past against peaceful protesters without violating a court order.”

Meanwhile, Police Chief James Craig said the order won’t change how his department handles protests because officers have used force only when protesters weren’t peaceful.

Court ruling...

"But the relief that Plaintiffs request leaves open all lawful options for police to use reasonable force when necessary to defend against a threat and to make arrests when supported by probable cause. And any possible benefit police officers could gain from deploying chemical agents, projectiles, or striking weapons against demonstrators who pose no threat and are not resisting lawful commands is outweighed by the irreparable harm peaceful protesters would face."

Craig said he agrees with the judge.

"This just reinforces our policy," he said. "We don't use force against peaceful protesters. In fact, we've allowed them to take over all lanes of streets, when technically, we didn't have to do that, because they didn't have permits. But we want them to be able to express themselves, so we allowed it."

is a radical group. They prefer that therapists approach violent criminals and police shouldn't arrest anyone. If you ask Detroit citizens, they want more police and don't agree with these people.
