Trump Could Be Investigated for Tax Fraud, D.A. Says for First Time

Source: NY Times

The Manhattan district attorney’s office, which has been locked in a yearlong legal battle with President Trump over obtaining his tax returns, suggested for the first time on Monday that it had grounds to investigate him and his businesses for tax fraud.

The assertion by the office of the district attorney, Cyrus R. Vance Jr., offered a rare detailed disclosure about the office’s investigation into the president and his business dealings, which began more than two years ago.

Mr. Vance, a Democrat, has never revealed the scope of his office’s criminal inquiry, citing grand jury secrecy. The investigation has been stalled by the fight over a subpoena that the office issued in August 2019 for eight years of the president’s tax returns.

Lawyers for Mr. Trump have said the subpoena should be blocked, calling it “wildly overbroad” and politically motivated. Mr. Vance responded to that argument in a new filing that did not directly accuse Mr. Trump or any of his businesses or associates of wrongdoing.

This explains the desperate, escalating authoritarian tactics Trump and Barr are using. Donald is running to run out the clock so he can stay out of prison.

isn't it? That's why Capone cleared out his vault before Geraldo could break into it.

Seriously, people forget that Capone went to jail because of tax fraud, not the murders, bootlegging, gambling, etc.

And don't forget, while in prison Capone's neurosyphilis progressively eroded his mental faculties. Perhaps that's why trump seems so out of it already?

I recall a news article posted here several weeks ago implicating Eric Trump in this--or another--investigation.

And Don Jr. was quoted telling a friend (or "friends" ) of his that he predicted his father would lose the election and that several members of the Trump family would be indicted.

Why are we still investigating crimes that took place maybe decades ago? This country needs to work on justice happening before the criminals all die of old age.

I have a feeling there were a few forgiven loans in there that were never claimed as income.

Loans from Russians, of course, who required certain services in return.

Make it a long, long time. And see to it that his evil spawn are incarcerated, too. It is way past time for their crime spree to end and for them all to get their punishment. I’m eagerly awaiting the day they all get frog marched to the pokey — all dressed in Orange prison jumpsuits. Can’t wait to see what tRump and Ivanka look like after a few months behind bars. A prison haircut ought to be fun to see on them.

... as Part of ‘Criminal Tax Fraud’ Investigation
MATT NAHAM

Manhattan District Attorney Cy Vance argued an appellate brief on Monday that he should be able to obtain President Donald Trump’s tax returns from a third party—namely, Trump’s finance firm—because news reports indicate that a “criminal tax fraud” investigation is warranted.

The brief filed in the U.S. Court of Appeals for the Second Circuit cited reports from The Washington Post, The Wall Street Journal, and The New York Times to provide a “snapshot” for the court of the Trump Organization’s “financial improprieties” that “could potentially violate New York law.” These articles addressed anything from Trump’s role in hush money payments Michael Cohen paid out before the 2016 election to allegations that Trump inflated his net worth to lenders and investors.

“These reports have identified transactions spanning more than a decade, involving individual and corporate actors who were based in New York County,” the brief said.

The potential New York laws that Vance’s office cited:

As discussed below, such reports place sufficient notice into the public record to render the SAC’s claims implausible. In particular, if misstatements about business properties, wherever located, were conveyed from that business’s headquarters in New York to New York-based business partners, insurers, potential lenders, or tax authorities, those misstatements could establish New York crimes such as Scheme to Defraud (Penal Law § 190.65), Falsification of Business Records (Penal Law § 175.10), Insurance Fraud (Penal Law §§ 176.15-176.30), and Criminal Tax Fraud (Tax Law §§ 1803-1806), among others.

My understanding is that New York can indict him, even if the Justice Dept. won't. And there won't be any pardons.
