Eric Trump must testify in response to a subpoena from the New York Attorney General’s office before the presidential election as part of an investigation into whether President Donald Trump’s company improperly valued real estate assets in official statements, a judge ordered Wednesday.
Eric Trump, who is the president’s middle son and a top executive in the Trump Organization, must testify no later than Oct. 7, Judge Arthur Engoron ruled after a hearing in Manhattan Supreme Court, where Trump’s lawyers had asked to delay his deposition until after the election.
Engoron noted that, “Mr. Trump cites no authority in support of his request, and at any event, neither petitioner nor this court is bound by timelines of the national election.”
Attorney General Letitia James’s office called the ruling a “major victory.”

President Donald Trump‘s son, top Trump Organization executive Eric Trump, must sit for a deposition before the 2020 election, New York State Supreme Court Justice Arthur Engoron ruled on Wednesday.
The ruling came almost a week to the day that it was reported that Eric Trump would comply with a subpoena—but only after the election. It also comes a day after Trump family nemesis New York Attorney General Letitia James (D) cited a Fox News Radio interview, in which Eric Trump uttered the words “why would you possibly comply.”

“A judge just ruled that Eric Trump can no longer delay an interview under oath with my office as part of our ongoing investigation into financial dealings of the Trump Organization,” James noted. “Eric Trump must interview with my office by October 7th, 2020.”
Last week, the Trump Organization opposed a motion to compel Trump’s testimony by saying he has “made clear that he is willing to appear pursuant to the subpoena, and have also proposed four available dates after the Presidential election on November 3, 2020.”

NEW YORK — A state judge on Wednesday ordered Eric Trump to be deposed no later than Oct. 7 in the New York attorney general's examination of the Trump Organization's financial practices, rejecting a protest by President Trump's son who has said he is too busy to meet with investigators until after November's election.
The ruling was handed down by New York Supreme Court Justice Arthur Engoron after nearly two hours of arguments in a lawsuit brought by state investigators conducting the civil investigation. The president’s company is managed by his two sons, Eric Trump and Donald Trump Jr.
“This court finds that application unpersuasive,” Engoron said, referring to Eric Trump’s stated need to put off an interview until mid-November. The judge added that he felt Eric Trump’s attorney had cited no legal authority to support the bid for a delay. “In any event, neither petitioner nor this court is bound by timeliness of the national election,” the judge added. An attorney for Eric Trump said during the hearing that the president’s son travels nearly seven days a week to make appearances on behalf of his father’s campaign.
The lawsuit was filed in August as lawyers in the state attorney general’s office reached a roadblock with lawyers for the Trump Organization, Eric Trump and lawyers for other potential witnesses related to testimony and documents that had not been turned over. Authorities have said the Trump Organization of potentially misleading lenders and duping taxing authorities, a probe that could result in civil penalties. The attorney general’s office began investigating the company after the president’s former personal lawyer Michael Cohen, a former executive with the company, gave Congress copies of financial statements from 2011 to 2013.
