Woman charged in US Capitol riot can take trip to Mexico, federal judge says

(CNN)A Texas florist charged in connection with the US Capitol insurrection will be allowed to go to Mexico later this month, a federal judge ruled Friday.

The case involving Jenny Cudd got national attention this week after she wrote to a judge asking for permission to visit Riviera Maya, Mexico, for a four-day retreat this month.

On Friday, Judge Trevor N. McFadden of the DC District Court granted her request. McFadden, a Trump appointee, noted that the Justice Department did not oppose Cudd's request to visit Mexico.

"The Court also notes (Cudd) has no criminal history and there is no evidence before the Court suggesting the Defendant is a flight risk or poses a danger to others," McFadden wrote in a written order.

She can spend time waiting for her case to be tried in one of the refugee centers set up for asylum seekers waiting their turns.

What I'm more curious about is whether there are provisions in law that allow the Department of Justice to request the State Department to temporarily or permanently revoke her passport. That would prevent her from leaving the country.

By asking the court to travel, she is meeting the conditions of her cash-free bail.

I know, I know, I don't agree. On paper, the judge probably has a right to allow her to travel. Another judge might disagree. The judge allowing her to travel is a Trump appointee.

So, this judge does not feel she meets the threshold, but another judge might disagree.

So seemingly they have no objection to letting her go on her vacation.

Then Mexico and other Central American countries will not allow these accused criminals to enter their lands.

My cousin is down there now.

They have a condo all to themselves. They pick up their food or have room service. They spend their days exploring nature. They have less contact with people than they do in the US. The flight has more risk than the resort.

What would cause a Brazilian to be granted "political asylum" from Brazil? I mean, apart from working for a Republican congressional primary candidate :

Walking through the U.S. Capitol rotunda, a camera around his neck, Eliel Rosa could’ve been mistaken for an eager tourist on any other day. But the Midland resident, who was granted political asylum after moving from Brazil to the United States more than four years ago, had broken into the Capitol alongside his friend, Jenny Cudd. A photo he posted from inside the building led FBI agents to identify him and issue a lengthy arrest warrant on charges of entering and remaining on restricted grounds, as well as disorderly conduct or violent entry. During an interview with the FBI two days after the siege, Rosa admitted he had entered the Capitol. Both charges he faces are misdemeanors, and together they carry penalties of as long as a year and a half in jail and a $100,000 fine.

Last year, the news website SanAngelolive.com described Rosa as a father and husband with “aspirations to earn his PhD in Public Policy and Constitutional Law,” and reported that he’d been tapped to serve as an immigration adviser to Jamie Berryhill, a Republican who would lose a GOP primary to represent a West Texas congressional district. On Wednesday, Rosa told a U.S. District Court judge that he’s been unemployed since coming to America, according to the Odessa American. Rosa could not be reached for comment, as of press time.

She can easily stay in Mexico and disappear, knowing that authorities won't spend too much time and effort looking for her. The statute of limitations can run out and she can return home.

Or she can go to Brazil from Mexico and stay with her friend's family.

I wouldn't be surprised if she says, "Screw You" to the system again and gets away with it.
