Gov. Ron DeSantis' lawyers want parents' push for mandatory masks thrown out

TALLAHASSEE Attorneys for Gov. Ron DeSantis asked a judge Friday to throw out a lawsuit by parents in a half-dozen Florida counties challenging the states ban on mandatory masks in school.
Leon County Circuit Judge John Cooper set a hearing date for next week on the proposed dismissal, a first step before any discussion of the effort to stop the ban on mask mandates takes place.
We believe that the complaint exhibits some significant deficiencies, said Michael Abel, a DeSantis attorney, in Fridays opening hearing on the lawsuit filed a week ago.
Abel said questions revolved around whether the parents had legal standing to challenge the governors order. He also said the dismissal should be considered on allegations the lawsuit was driven by politics and that a court ruling against DeSantis would violate his executive branch authority.

Parents don't have legal standing? Floridians can't sue their governor for violating his authority? Great arguments.

(26,727 posts)If the order was that children couldn't wear masks... that would be a pretty easy question.
Whoever at the county level would normally have the authority to require mask-wearing (school boards perhaps)... they should have some standing to sue.
But parents in a school district?

(12,582 posts)Despite what Repug governors and TFG believe, they aren't gods. They are ultimately responsible to the people, and must bow to the rule of law, not what's politically expedient for their own political ambitions.
I'm not sure how the court will rule on the standing question. Ruling the parents don't having standing to bring the action is a good way for a judge to kick the can down the road.
