Texas Supreme Court temporarily halts mask orders in Dallas and Bexar counties

The Texas Supreme Court on Sunday temporarily blocked mask mandates in Dallas and Bexar counties, marking a pivotal moment in the showdown between state and local government as coronavirus cases and hospitalizations surge in Texas.
The ruling comes after several school districts and a handful of counties across the state defied Gov. Greg Abbott's executive order that restricted local entities from instituting mask mandates. On Friday, the 4th Court of Appeals in San Antonio upheld a lower court ruling that permitted Bexar County to require mask-wearing in public schools. Shortly after, the 5th Court of Appeals in Dallas upheld a more far-reaching order from Dallas County Judge Clay Jenkins that required masks in public schools, universities and businesses.
In a petition for a writ of mandamus to the Texas Supreme Court, Texas Attorney General Ken Paxton's office said the Texas Disaster Act of 1975 gives the governor power to act as the "'commander in chief' of the state's response to a disaster. Attorneys representing cities and counties that have sued Abbott over his executive order have argued that his orders should not supersede local orders.
Fueled by the highly-contagious delta variant, hospitalizations have increased across the state at a pace quicker than any other point during the pandemic. Less than half of the state's population is fully vaccinated.

The news is a relief to parents who oppose masking children, who are statistically not at risk from COVID-19.
Children seem to have lower risk of serious illness, though Im not sure we can say even that about the Delta variant, but their risk is definitely not zero. They can certainly spread the virus to the adults they come in contact with at school too.

If they didn't impeach Paxton after an actual indictment... they obviously aren't going to impeach Abbott.

DALLAS - Dallas ISD's superintendent said the school district will keep its mask mandate in place despite the Texas Supreme Court ruling that temporarily blocked Dallas County's mask mandate.
Dr. Michael Hinojosa said he made this decision after consulting with lawyers and they determined the stay order issued by the Texas Supreme Court Sunday was for Dallas County, but did not mention Dallas ISD.

(11,562 posts)I don't know for sure, but I'd hazard a guess that TX has a pretty large population of undocumented residents. If "Less than half..." is, say, 45%, I'd think the true number would be 35-40% at best

(1,666 posts)We need the masks in order to stop the spread, but this sets an example of being able to ignore Supreme Court (federal or state) decisions if you dont like them. I can think of a few the GOP would like to ignore, if that is the new standard.
