FCC Fines Jacob Wohl And Jack Burkman $5.1 Million

First, a reminder about the case:
Jacob Wohl, a conservative activist known for his largely bumbling attempts to stage political scandals, has been charged with running a robocalling scheme to spread false election information. Michigan Attorney General Dana Nessel filed four felony charges today against Wohl and his partner Jack Burkman. They're accused of targeting Detroit residents with calls that discouraged voting, including false claims that mail-in ballots would let health agencies "track people for mandatory vaccines."
Wohl and Burkman allegedly targeted voters in Michigan, New York, Pennsylvania, Ohio, and Illinois, making a total of around 85,000 calls in August. The calls claimed to come from a group called "Project 1599, a civil rights organization founded by Jack Burkman and Jacob Wohl," and they were aimed at areas with large Black populations, urging them to not "be finessed into giving your private information to the man."

This sentence essentially supports the idea that if you're rich enough to pay the fine, this kind of thing is consequence-free.
Also note that this is a proposed fine.

And as far as getting the fine (whatever it turns out to be) paid had Loser-45 won Michigan, I dont think so. These are 2 genuine pain in the ass losers and wouldnt get any help -- mainly because they are too far down the line to matter to the big money Plutos in the GOP.

(33,643 posts)Maybe nobody would've payed his fine, but had the tactic seemed to have worked, I could see big $$$ people deciding it might be worth the risk to fund these kinds of operations on a larger scale, and build the fines into their 'cost of doing business'.

He should be very glad I wasn't on duty at the time. I would have had them both thrown in jail on prostitution-related charges, and the worst district attorney in America could get a conviction on that one.

(4,170 posts)Furthermore, they can only collect fines if those they fine willingly pay them. If not, they would have to likewise refer the fines to the Department of Justice, who may or may not elect to bring the matter to court to attempt to enforce collection.

The Federal Communications Commission on Tuesday proposed fining Jacob Wohl and his associate Jack Burkman $5 million for making more than 1,000 unsolicited robocalls. Wohl and Burkman targeted areas with high percentages of Black voters in apparent attempts to discourage them from voting by mail in the lead up to the 2020 election. They faced a lawsuit in New York, as well as Ohio and Michigan indictments. The FCC said in a press release, The robocalls in this case, made on August 26 and September 14, 2020, used messages telling potential voters that, if they vote by mail, their personal information will be part of a public database that will be used by police departments to track down old warrants and be used by credit card companies to collect outstanding debts. According to the FCC, the calls identified Wohl and Burkman by name. Burkman told a New York court of the 1,141 dials, That is our call, yes, yes.

On Tuesday, the Federal Communications Commission proposed an over $5 million fine against conspiracy theorists and conservative activists John Burkman and Jacob Wohl for making hundreds of robocalls spreading 2020 election misinformation.In its proposal, the FCC said that the agency is weighing a $5,134,500 fine against Burkman and Wohl for making over 1,100 robocalls in violation of the Telephone Consumer Protection Act, or TCPA.
The violating pre-recorded calls told voters that their personal information would be part of a public database that would be used by police departments to track down old warrants and be used by credit card companies to collect outstanding debts if they chose to vote by mail in the 2020 election. Its the largest TCPA fine the FCC has ever proposed, according to a press release from the agency Tuesday.
Last October, Michigan Attorney General Dana Nessel filed four felony charges against Burkman and Wohl, accusing the pair of discouraging Detroit residents from voting in the 2020 election. Specifically, the case accuses them of targeting voters in Michigan, New York, Pennsylvania, Ohio, and Illinois in around 85,000 calls last August. According to the Michigan Attorney Generals Office, the calls claimed to come from Project 1599, a civil rights organization founded by the pair and targeted areas with large populations of Black voters.
We remain committed to defending democracy against misinformation spread in an attempt to undermine our free and fair elections, Nessel said in a statement earlier this year. A trial date has not been set.

This time they went too far - basically telecommunications fraud and a myriad of election violations including intimidation. Some of this came out during an investigation by SDNY.

Why they are still walking around free (outside of people continually paying their bail) is beyond me, but I expect it was because we all know what was going on last year (and this year) with the pandemic, and the jails/prisons were releasing "non-violent" people due to the rampant spread of the virus in the cell blocks.
They both belong in jail for a long long time.

The penalty, which is not final, is the largest proposed by the FCC for this specific violation. The agency has, however, imposed much larger fines for spoofing robocalls, where the caller makes it appear as though a call is coming from a different number. This year it fined Texas telemarketers $225 million.
Wohl and Burkman will have a chance to respond, and the penalty could require a commission vote before it is finalized.
