Historic and Profound Abuse': In Blistering Opinion, Judge Sanctions Kraken Lawyers Over Election La

Source: National Law Journal

A federal judge has ordered the attorneys behind a Michigan lawsuit seeking to overturn the 2020 election results to face sanctions, including referrals for potential disbarment.

U.S. District Judge Linda Parker issued the orders in response to motions for sanctions filed by lawyers for the city of Detroit and the state of Michigan over the quickly rejected election challenge. Her order affects lawyers Sidney Powell, Lin Wood, Howard Kleinhendler, Greg Rohl, Julia Haller, Scott Hagerstrom and Emily Newman. These are the first sanctions issued against Powell and her team of attorneys.

Parker ordered plaintiffs’ counsel in the case to pay attorneys’ fees for lawyers for the city of Detroit and Michigan state officials and to be referred to disciplinary authorities in Michigan as well as the attorneys’ home districts for investigation “and possible suspension or disbarment.” She also ordered the lawyers to take 12 hours of continuing legal education courses on pleading standards and election law.

“This lawsuit represents a historic and profound abuse of the judicial process,” Parker wrote in opening her opinion. “It is one thing to take on the charge of vindicating rights associated with an allegedly fraudulent election. It is another to take on the charge of deceiving a federal court and the American people into believing that rights were infringed, without regard to whether any laws or rights were in fact violated. This is what happened here.”

The federal judge said that, while others may be able to “disseminate allegations of fraud unsupported by law or fact in the public sphere,” attorneys cannot “exploit their privilege and access to the judicial process to do the same.”

"The attorneys who filed the instant lawsuit abused the well-established rules
applicable to the litigation process by proffering claims not backed by law;
proffering claims not backed by evidence (but instead, speculation, conjecture, and
unwarranted suspicion); proffering factual allegations and claims without engaging
in the required prefiling inquiry; and dragging out these proceedings even after
they acknowledged that it was too late to attain the relief sought.
And this case was never about fraud—it was about undermining the
People’s faith in our democracy and debasing the judicial process to do so."

The plaintiff's lawyers have to reimburse the State of Michigan and the City of Detroit for their legal fees, but not Rob Davis' (an individual voter) because the judge ruled his intervention distraction to the case.

The plaintiff's lawyers each have to take six hours of classes on court standards and six hours of classes on election law at their own expense.

The court is forwarding referring its decision to the Michigan Attorney Grievance Commission and to the disciplinary committee in other states for which the lawyers are licensed to practice law so that the attorney's can be investigated for disciplinary action.

they are special, that neither will the buffoon ever throw them under the bus, or that they will never suffer consequences from following the bastard down the rabbit hole.

I do hope they all get disbarred, that should frighten other lawyers from trying to do the same in the future. These SOBs must face consequences.

Someone should send Powell a photo of Hugo Chavez with dates of his birth and death for her to remember how stupid and ignorant she was, and most probably is.

"Loyalty" doesn't mean squat to Trump. If they had done a little reading they would have known this. If you break the law, on Trump's behalf, and get caught, if you lie like a rug before a judge and get caught, You're On Your Own. It's spelled "YOYO."

dishonorable discharge of lawyers who dare judges to challenge those lawyers' batshit crazy.

I was anxious to see the courts let attorney insurgents get away with it, but now feel relief that Judge Parker gave them time to provide the evidence for their own disbarment. So the courts will hold, and given the strength of her referrals, state bars will follow.

in the scheme to undermine democracy. The book, written by Republican strategist Rick Brown, delivers “a searingly honest, bitingly funny, comprehensive answer to the question we find ourselves asking most mornings: ‘What the hell is going on?’ " According to the description on Simon & Schuster's website: The Guardian hails Everything Trump Touches Dies, saying it gives, “more unvarnished truths about Donald Trump than anyone else in the American political establishment has offered. Wilson never holds back.” Rick mercilessly exposes the damage Trump has done to the country, to the Republican Party, and to the conservative movement that has abandoned its principles for the worst President in American history. more

The attorneys should have known that when you hitch your career to a shooting star, it's likely to burn up in a blaze of glory. Well not glory exactly; it will become a flaming bag of shit set on the porch of the judicial branch. I wonder what their next careers will be? Not really -- I could care less what happens to them.

"U.S. District Judge Linda Parker issued the orders in response to motions for sanctions ..." What you did and response you got from the Judge Parker will be taught in Law Schools for as long as the USA lives as a democracy.

Now, you will live with the stench of Trump on you for the rest of your lives.

Why do (hopefully soon to be) disbarred attorneys need 12 hours of continuing legal education?
