NYC Teachers Ask Supreme Court to Block Vaccine Mandate

A group of New York City teachers have asked the U.S. Supreme Court for an emergency order blocking the city's vaccine mandate from going into effect Friday.
The petition asks Justice Sonia Sotomayor, who is the circuit justice for this part of the country, to issue an emergency injunction blocking the mandate, which they claim would force thousands of public school employees out of work if it were to remain in place.
"In attempting to combat the COVID-19 virus, the City of New York, the
Department of Education, and the Department of Health and Mental Hygiene created an Executive Order that places an unconstitutional burden on public-school teachers," lawyers for the teachers wrote in their 12-page petition.

U.S. Supreme Court Justice Sonia Sotomayor on Friday blocked a challenge to New York City's vaccine requirement for public school teachers and employees, allowing the mandate to remain in place.
Why it matters: Mayor Bill de Blasio announced in August that all 148,000 staff members of the largest U.S. school district would need to submit proof of at least one dose of a COVID vaccine or risk unpaid leave until September 2022.
The deadline was pushed to 5 p.m. EDT on Oct. 1 after a lower court temporarily blocked the order.
With the order now lifted, a group of four teachers and teaching assistants petitioned the Supreme Court to bar enforcement of the mandate while litigation is ongoing in lower courts.

They cannot see that they are misinformed no matter how many times they are explained how this works and why it is safe. I'm done giving them an excuse for being obstinate at this point. Now, if teachers are quitting because they aren't getting compensation commensurate with the job they are doing, I understand that.
But apparently, getting a safe and effective vaccine like 90% of their compatriots was just too much.
And it's not "forcing" anyone out of work. They have done that to themselves, by refusing to comply with a requirement of the job.

(4,787 posts)Justice Sotomayor is the justice for the 2nd Circuit, which includes NYS, Connecticut and Vermont. Thus, she gets requests for injunctions arising from those states.

(3,254 posts)It involves termination and there is nothing in their contract allowing this. If the court rules against them I don't think that will be overly upset. It's part of the job of the union to act like a defense lawyer. It's a big hit to lose 15000 dues paying members. As a former teacher and union rep I hope Sotamayor tells them to go fly a kite. I'm guessing the next contract will spell out a vaccine policy.

to get one but then they don't get to teach in public schools.]

(10,749 posts)You know, though, a "group of teachers" could be anything. Who? How many? New teachers? Old teachers? Eligible to retire teachers? Rubber room teachers? Was it their initiative or another group, e.g., union, astroturf group, non-NY lawyers.
This is like the stories about United Airlines, WHICH FIRED ALMOST 600 EMPLOYEES WHO REFUSED TO BE VACCINATED. The fact that 59,500 people got vaccinated and kept working was a minor point, where it should have been the headline. So I've stopped getting too worked up over stories like this. You know what they say. In any dispute involving lawyers, you can be sure of one thing. The lawyers will be the ones making all the money, however things turn out.
