A New York judge rules that the state's mask mandate is unconstitutional and can't be enforced.

In December 2021, amid a winter virus surge, Gov. Kathy Hochul renewed a mask mandate at all indoor public places throughout the state including schools and nursing homes, and on public transit to last a month. The state Health Department then extended the mandate an additional two weeks, to expire Feb. 1.
In his decision, State Supreme Court Justice Thomas Rademacher wrote that Ms. Hochul and state health officials lacked the authority to enact the mask mandate without the approval of state lawmakers. Regardless of the well aimed intentions of state officials, this is entrusted solely to the State Legislature, Justice Rademacher wrote.
The state attorney generals office is planning to appeal the ruling. And Emily DeSantis, a spokeswoman for the state Education Department, said the state Health Department would appeal, which would automatically restore the mask rule until an appellate court issues a ruling.

(792 posts)We have the votes for this right? I think most NYers would be ecstatic to see a permanent legal enforcement of the masks as well as vaccines.
Just make it part of state law that to be in NY you must have all your medical requirements up to date on your vaccine passport. It would also make the state well-prepared for any future issues that need central medical planning.

Maybe add some stipulation that the action has to be backed by the scientific consensus? I don't know what more would be needed, and I think it'd get broad support.
We can't just sit around waiting for people to do the right thing. We all agree we need mandates to get the gqp vaccinated and masked so we can end this fucking hell. They're never going to do it out of the goodness of their heart, and until they're forced to do so they'll be creating new mutants and endangering the rest of us.

"While the intentions of Commissioner Bassett and Governor Hochul appear to be well aimed squarely at doing what they believe is the right to protect the citizens of New York State, they must take their case to the State Legislature," Rademaker wrote.
"Should the State Legislature, representative of and voted into office by the citizens of New York, after publicly informed debate, decide to enact laws requiring face coverings in schools and other public places then the Commissioner would likely be well grounded in properly promulgated and enacted rules to supplement such laws."
"To be clear, this Court does not intend this decision in any way to question or otherwise opine on the efficacy, need, or requirement of masks as a means or tool in dealing with the COVID-19 virus," the judge wrote. "This Court decides only the issues of whether the subject rule was properly enacted and if so whether same can be enforced."

Removing the COVID specifics: is it OK for a chief executive to enact a de facto law bypassing the legislative branch which has the sole power to create and pass legislation?
Just pause for a moment and think about this and I mean really think about it. Can you envision a situation where this power could/would be abused?

A New York appeals judge left the states indoor mask mandate in place Tuesday while Gov. Kathy Hochuls administration appeals a lower courts decision to overturn it.
Judge Robert Miller granted the states request for a stay of a Long Island judges ruling Monday that the governor and health officials lacked authority to require masks.
Arguing before Miller Tuesday, Judith Vale, an attorney for the state, said judge Thomas Rademakers ruling would radically disrupt the status quo and endanger the health of students and staff at schools.
The order, if not stayed will allow individuals to refuse to wear face coverings in indoor public settings where the risk of COVID-19 spread is high, including in schools where many children remain unvaccinated against COVID-19, the states court filing said.
