Judge Holds Trump in Contempt Over Documents in New York A.G.'s Inquiry

Source: New York Times

A New York judge on Monday held Donald J. Trump in contempt of court for failing to turn over documents to the state’s attorney general, an extraordinary rebuke of the former president.

The judge, Arthur F. Engoron, ordered Mr. Trump to comply with a subpoena seeking records and assessed a fine of $10,000 per day until he satisfies the court’s requirements. In essence, the judge concluded that Mr. Trump had failed to cooperate with the attorney general, Letitia James, and follow the court’s orders.

“Mr. Trump: I know you take your business seriously, and I take mine seriously,” Justice Engoron remarked, before holding Mr. Trump in contempt and banging his gavel. The ruling represents a significant victory for Ms. James, whose office is conducting a civil investigation into whether Mr. Trump falsely inflated the value of his assets in annual financial statements.

In January, Ms. James, a Democrat, said her office had concluded that the Trump Organization had engaged in “fraudulent or misleading” practices involving the statements. But she said she would continue to investigate before deciding whether to sue Mr. Trump or his company. Although Ms. James does not have the authority to file criminal charges, her civil inquiry is running parallel to a criminal investigation led by the Manhattan district attorney, Alvin Bragg, who is examining some of the same conduct.

I self-deleted my LBN post on this when I saw this thread.

This will be fun to watch

New York judge is holding Donald Trump in civil contempt after the state's attorney general's office said he did not comply with a subpoena for documents as part of its investigation into the former President's company.

Judge Arthur Engoron said Trump failed to abide by his order to comply with the subpoena, and that his attorneys failed to show how a search of materials held by Trump was conducted. Engoron said Trump would be fined $10,000 a day until he complies.

"Mr. Trump, I know you take your business seriously and I take mine seriously. I hereby hold you in civil contempt and fine you $10,000 per day until you purge that contempt," Engoron said at a hearing Monday.

New York Attorney General Letitia James' office has been investigating the Trump Organization for more than two years and previously said her office found multiple misleading or fraudulent misstatements and omissions in the Trump Organization's financial statements, which were provided to lenders and insurers, among others, as part of its investigation.

The contempt order could be short-lived. If Alina Habba, one of Mr. Trump’s lawyers, files a sworn statement detailing every step that was taken to locate potential documents, the judge might be satisfied, lawyers close to the case said. Ms. Habba said after the hearing ended that she intended to file such a statement, potentially by the end of the day.

This has to satisfy the judge. It would appear lawyers said, "We looked, honest," and that isn't good enough.

Also:

This month, lawyers from Ms. James’s office said that Mr. Trump had declined to turn over documents in response to eight separate requests, and called for him to be held in contempt and assessed a daily fine of $10,000 as long as he continued to not cooperate.

I'm thinking it might be hard to prove well enough that they really did try. I'll bet they destroyed the records. No matter, property valuation and tax records can be obtained from official sources.

Keep in mind that this is a civil suit, not a criminal one, which would need to be pursued by Bragg, who seems to have dropped the ball.

Yes. Yes it is "extraordinary".

Compared to Alvin Bragg, and the long list of other examples of letting Trump off scott free.

The real question should be..... Why simply following the law, and filing contempt charges after noncompliance of the court, after months of ignoring them, is an "extraordinary rebuke" against Trump.....but not for anyone else who dares to defy the court that way.

Just because of his last name? Because he was a former President? Why isn't the story framed as Trump himself the one responsible for an "extraordinary rebuke" of the courts?

A Manhattan judge has ordered Donald Trump's longstanding appraisers, Cushman and Wakefield, to turn over documents to New York Attorney General Letitia James.

The decision is the second victory Monday for James' probe of the former president's business dealings; in a press statement, James promised, "our investigation will continue undeterred."

Earlier Monday, the same judge, New York State Supreme Court Justice Arthur Engoron, held Trump personally in contempt of court and ordered that he, too, comply with James' subpoenas, which in his case seek his personal business documents.

Trump additionally must pay a $10,000-a-day fine, Engoron ordered.
