Prosecutors in the special counsel's office have presented compelling preliminary evidence that former President Donald Trump knowingly and deliberately misled his own attorneys about his retention of classified materials after leaving office, a former top federal judge wrote Friday in a sealed filing, according to sources who described its contents to ABC News.

U.S. Judge Beryl Howell, who on Friday stepped down as the D.C. district court's chief judge, wrote last week that prosecutors in special counsel Jack Smith's office had made a "prima facie showing that the former president had committed criminal violations," according to the sources, and that attorney-client privileges invoked by two of his lawyers could therefore be pierced.

Trump has repeatedly denied any wrongdoing in his handling of classified documents.

In her sealed filing, Howell ordered that Evan Corcoran, an attorney for Trump, should comply with a grand jury subpoena for testimony on six separate lines of inquiry over which he had previously asserted attorney-client privilege.

Now if some of it has been documented as finding its way into his campaign funds, that's different. After all, there's no law against having RT broadcasting, they've just been deplatformed by cable and satellite because while they tolerate p,enty of sick propaganda from Pox and its clones, they do have limits.

Remember, we are not at war with Russia. I hope we never will be, honestly. I just want Ukraine to be able to kick them out.

obtained from their sit-downs with Trump's other scummy lawyers that were subpoenaed and testified before the grand jury...and then there's Evan Corcoran..as to Trump's return of all documents, Corcoran knew better than to put his name to the certification of compliance and insisted Christina Bobb sign the compliance subpoena..

so I'm assuming Corcoran is going to claim to be another innocent taken in by big bad lying Donnie...right...

If his lawyers say, "He lied to me," and testify against trump it's even better. He'll have to pay even more to get legal representation, and given his history no competent attorney should accept him without a full value retainer.

Anyone who knows TFG's MO would have had him sign a document stating all files had been returned. A smart lawyer would only have witnessed his signature.

Of course he did this. It's what I'm sure a lot of us have been assuming, and it's nice to see some confirmation. What I don't understand is why any of his attorneys would take his word about "retention of classified materials" or absolutely anything else whatsoever. If he told me it was raining, I would assume the sun was shining, until and unless I was able to independently confirm it for myself. Same
with anything else in the entire universe of words that he might utter.

Does he deliberately choose lawyers based on their willingness to believe any b.s. that splutters out of his ugly little anus-mouth? Or is he hiring nincompoops because all the lawyers with a lick of sense are refusing to work for him? I honestly think it could be either, or both.

as "cover" and knowingly manipulates what they're told. He also comes up with some of these various "schemes" for defense strategy etc. and orders the lawyers to file some of this stuff despite knowing they are horse crap. All for the sake of delay and to later claim to be blameless and that he only relied upon legal advice and that the advice was faulty etc.

claims of attorney-client privilege that had previously kept 2 of his attorneys from having to testify on those "lines of inquiry." Again, this big deal is in DC, not NYC, DoJ classified documents criminal investigation, not porn star hush money.

Lawrence O'Donnell says he's never seen such an "ultra high-speed appeal" of a ruling order a tRump attorney to testify, tRump attorneys given a filing deadline of midnight tonight and Jack Smith a response deadline 6 hours later at 6 a.m.

So relaxed and quiet here at 11:15 p.m. ET.

Sounds to me like Smith is trying to give Trump's lawyers an out.
They can claim they were lied to be their client, and thus avoid being charged with obstruction themselves.
If those lawyers care about their futures in law, they will take this olive branch and cooperate with the DOJ by conceding they had a client who was not being honest with them. If they stick by him, they make themselves party to whatever crime their criminal client was attempting to perpetrate.
Leastways that is what I see Smith doing with this.
