Moment of Truth in Trump Case After 'Extraordinary' Late Night Legal Battle
Source: The Daily Beast
"A heated battle over whether a Trump attorney can be forced to testify is now in the hands of an appeals court."
"A U.S. appeals court is expected to rule shortly on whether Trump attorney Evan Corcoran can appear before a grand jury in Donald Trump's Mar-a-Lago classified documents case."
"The move comes after a dizzying saga overnight, in which the U.S. Department of Justice and attorneys for Trump filed dueling motions over Corcoran's testimony. At the heart of the battling motions is a Friday ruling in which a federal judge reportedly sided with the DOJ, finding that Corcoran could be compelled to testify because prosecutors had sufficient evidence Trump may have used one of his defense attorneys in an alleged bid to mislead investigators."

This might be a few things, all of which are speculation:
1) There is some imminent threat to National security at issue.
2) There could be concern about interfering with an active grand jury.
3) The court is all done being used for delays
4) A combination of things.
It's al under seal, so there's no real way to know until it's ultimately revealed.
Whatever it is, the court deemed it important enough to go at it lightspeed handling the complaint.
Attorney client is sacrosanct. Piercing it, even in a national security context of criminal activity is rare. That lawyer is important to the investigation.
Optics and the lack thereof, color this in my mind as an espionage case that's an imminent national security issue.
I can't think of any other reason they would move this quickly.
I am not an officer of any court.

(21,319 posts)"The appeals courts order from Judges Cornelia Pillard, J. Michelle Childs and Florence Pan, all Democratic appointees doesnt identify Corcoran or the case at issue but makes clear that the government was on the winning side of the case in Howells court."
It seems to me the Appeals court has already made up its mind.

(5,841 posts)Of course, we're short on details, but the emergency nature of these proceedings has me really, really curious why the incredible hurry.

(21,319 posts)Why Not? Maybe the courts are getting fed up with frivolous appeals? If there is no substance to an appeal why delay a decision for months? Maybe this is just a case of Occam's razor?

(5,841 posts)... just because they're tired of the bullshit. Fast would be giving a day to file this. Instead, it all happened practically overnight. That's lightning speed.
There's a specific reason this all happened in the dead of night.

My sense is that there are now a plethora of straws that have broken the proverbial camel's back.
One might also frame this as all of Trump's Strawmen and other Henchmen, being torn all asunder by reasons swift wind.

(7,295 posts)But kinda rough to demand the Federal prosecutors to deliver a response in 6 hours.... overnight.
Oof.
That indicates to me it's not just frustration with Trump's people, but maybe another external friver, like a scheduled appearance and the witness's availability. For example, what if they know that Trump's awyer is gonna be pretty busy very soon, so they want to make sure they can meet an appearance window that supports that.

(912 posts)1. Avoid delay.
2. Somehow related to the retiring judge's timeline.
3. National security issue. But, have seen some commentators dismiss this idea.
Or combination?

(5,841 posts)Here's a crazy timetable. All-nighters are not just for college finals week.
Remember that Beryl Howell ruled that Evan Corcoran (Trumps lawyer) must testify because the crime-fraud exception applies.
In addition to being ordered to testify, Corcoran has to turn over related documents including handwritten notes, invoices, and transcriptions of personal audio recordings.
Yup, there are tapes.

Well said y'all!
There have been a nauseating number of horrible "firsts" that have "poked the bear" in our system of governance continuously since the GOP adopted the KKK. That's more than a year or two.
Trump's Administration squeezed more shit out of their ass than any administration in my lifetime.
I'm 60.
Economics 101 taught me four basic principles that I cling to too this day.
1.)Vote With Your Dollars
2.)Vote With Your Feet
3.)It Takes Longer For An Occurrence to Manifest Than One Anticipates.
4.)Once Manifested It Takes Less Time Than One Anticipates To Be In Full Bloom
I see our system of governance's "bears" "beginning to bloom".
Re-reading this, I'm reminded of Chauncey Gardner and Nirvana simultaneously, lol.
So take my thoughts with that proverbial grain of salt...
Laissez bon temps rouler y'all, don't let the months get ya' down!
