Appeals court rules against Trump attorney, ordering him to comply with subpoena

Washington — An appeals court in Washington, D.C., has ruled against an attorney for former President Donald Trump, ordering him to comply with a federal grand jury subpoena to testify and provide information about his communications with Trump in its investigation into possible mishandling of documents with classified markings found at his Mar-a-Lago residence.

Trump's legal team could appeal the ruling to higher courts, but a person familiar with the case says that's not likely at this point. It is likely that Corcoran could appear before the grand jury on Friday to testify about notes and exchanges with his client, Trump, about the former president's handling of classified records. CNN first reported the potential date of his appearance.

Trump has maintained he's innocent and denied all wrongdoing in the case. His representatives did not immediately respond to request for comment, and the Justice Department also declined to comment. Late Tuesday, a three-judge panel had ordered Trump's legal team and prosecutors in special counsel Jack Smith's office to file briefs about whether the attorney, Evan Corcoran, could be compelled to address specific issues of interest to investigators.

Proceedings and written arguments remain sealed because grand jury matters are by law protected from public scrutiny, but brief entries on the public docket between midnight and 6 a.m. Tuesday showed filing deadlines for the dueling parties and ordered Trump's team to highlight specific documents at issue.

and stuff all over their website but they were linking to the earlier district court ruling not the appeals one, and that my have been their boo boo because a decision DID just come out.

I saw a heads-up tweet from Kyle Cheney about this but even he didn't have anything about it on Politico yet.

What happens next? Presumably the appeals court will rule pretty quickly — before noon and maybe even by 9am.

Keep an eye out for Trump lawyers appearing at the federal courthouse today, and possibly even for Corcoran to testify.

It's HIM.

People are seeing why nothing was done the past 50 years because no one had the time, the resources, or the determination to get through what would be an extended nightmarish labyrinth of the gaming of the legal system, including navigating around a judiciary with judges appointed by him. There literally needed and still needs to be, "all hands on deck" to deal with it.

And even then, it would have been easier to nail him before he became President because once he was elected, that seemed to be an immediate "shield" that he dare not lose (but thankfully he mostly did). That is why he kept trying to find ways to maintain that "shield" by directing that fraudulent pathways be found that ensured that he stayed in office (including to this day insisting on extending "Executive Privilege" beyond his term of office as some right and justification for protection against adjudication of every bit of criminality that he engaged in).

His endless abuse of the court system wears opponents out.

But this time it appears at least one court has HAD IT with the endless delay tactics. And this time he's up against the DOJ, which hired a hell of a lot of lawyers recently, and who can easily respond to expedited filing deadlines. Case in point: their 6,500-word brief, which they had ready by 5:30 am. His legal team of Dewey, Cheatham, and Howe won't be able to keep up with the DOJ. Boy, hiring all those lawyers was genius.

I would love to see every judge who has his cases take the same tactic: expedite the process. It's clear the DOJ's lawyers can handle it; his 2-bit cheap-ass lawyers can't.

The fact that "deep pocket" DOJ had to go full bore with staffing up to basically handle multiple cases and multiple grand juries, is a case in point regarding the level of offense that is needed to get the ball this far down the field.

I keep this in a tab but this from awhile ago (I think this past October) that summarized the issues -

It has become quite clear that 'most' of the judicial system is well aware of IQ45's legal stall tactics - and they are responding accordingly. Those that are not will suffer the 'career' consequences down the road - lack of promotions, lack of respect, loss of credibility. But they were obviously willing to give up their own personal integrity just to kiss the A$$ of tRump and the MAGA's.

It seems to me the Appeals court has already made up its mind.
