CNN: DOJ Has Proof It Alerted News Corp. Of Rosen Subpoena

The Department of Justice claims it has proof it alerted the parent company of Fox News of a warrant used to obtain the phone log records of Washington correspondent Rosen as part of an investigation into a 2010 leak of classified information, according to CNN.

"The Justice Department is telling us here at CNN....that it showed a Fox News notification according to the Justice Department of this James Rosen investigation nearly three years ago," CNN's Jim Acosta said on air Wednesday. "To back that up, earlier this afternoon Justice and law enforcement producer Carol Cratty was shown by a law enforcement official documents indicating as much of this notification to the parent company of Fox News, News Corporation."

The Justice Department previously said it had notified News Corp. of the seizure on Aug. 27, 2010, but company officials over the weekend said they had no such record. News Corp.'s chief legal counsel at the time also strongly denied receiving a subpoena from the government.

"Consistent with the department policies, and procedures, the government provided notification of the subpoenas they're saying for phone records and other pieces of information nearly three years ago by certified mail, fax, and e-mail," a DOJ official said in a statement obtained by Acosta.

well labeled and easily accessed is number one. Date stamps on everythng, faxes, e-mails, receipts, etc. Let's thank the secretary ( and we know it was her/him that found it) for putting an end to this nonsense...

I served papers for almost 20 years...there is a statutory process which includes all of those methods and personal service. Personal service is the most difficult to deny receiving, and almost nobody who is personally served attempts to claim they weren't..I had several service disputes over the years and none were ever lost which involved personal service because I could testify exactly the time, day, and person who I served. Some people didn't want to be served and it took days or weeks to get close enough to serve them, but the lawyers who wanted their ducks in a row always wanted personal service for important matters..sounds like lazy process by the Justice Department..this could have been avoided if they had a US Marshal, law clerk/prosecutor, or FBI agent deliver the paper..News corp could weasel out of this because of ineffective service..

What happens if I go up to somebody with top secret clearance and offer to pay for classified docs?

Oh ho! I'm just part of the knowledge class! Can't blame me. Just doin' muh job!

Gimme a break. Rosen was way out of bounds of any justifiable journalistic activity. It's not the journalists job to suborn criminal activity.

Not only asked for more classified docs, he had the nerve in one email to tell Kim he wanted any docs that would help embarrass the Obama Admin into taking a stauncher position against North Korea. Not the act of a happy go lucky news hound just doing his job like we see in some classic movie. Not only did Rosen leak classified info in the first article he wrote, Rosen revealed that the leaked info came from deep within North Korea....in other words, undercover operative or someone in the North Korean government willing to speak with our intelligence community. Rosen endangered our network and this country, not to mention North Korea's neighbors. We need to know what is going on inside North Korea and Rosen may have destroyed that for his (or who else's) political gain.

Which apparently is considered normal for an investigation of this sort. Telling a person in advance would give them an opportunity to destroy records, of course.

If it was me, I would be investigating their whole Party! Impeachment be damed. Criminals can't impeach anything, because they are all crooks.
