Provisional Vote Totals Will Be Announced Tuesday

Newly counted absentee ballots in Virginia’s 8th District could swing the election of Attorney General to Democrat Mark Herring. ... Brian Schoenenman, a Republican official on the Fairfax County Electoral Board, said via Twitter that a new vote count for the 8th District had 5,137 votes for Herring, 2,039 votes for Republican Mark Obenshain, and ten write-in votes, a change of 1,132 votes in favor of Herring. Schoeneman made the announcement after the board met early Saturday morning to investigate an apparent error in absentee ballot returns.

According to results posted on the Virginia Board of Election page, Obenshain was ahead by 1,262 votes, but those numbers did not include the new results from Fairfax County or any provisional votes cast on Election Day.

The meeting centered on discussion of the results of two optical scan machine tape records – one that had been included in the results and one that had not. The election staff was instructed to complete the canvass of votes and present their findings.Those findings are the basis of Schoenenman’s announcement.

Schoeneman said a new ruling on Friday from the State Board of Elections requires voters who cast provisional ballots to be present to have them counted. Because of that ruling, he said all provisional vote totals in Fairfax County won't be announced until Tuesday.

First time I've ever heard that rule.

Will these voters be contacted, or will this be an "under the wire" operation?

I'd think it would be up to the State Board of Elections to contact provisional ballot voters, if they had any questions.

That seems like it would be facing a court challenge.

I cant see how its legal to change the rules after the election.

Scalia, Cheney/Halliburton, Ken Blackwell (OH Sec of State responsible for making rules re: voting during the Bush-Keerry election who also happened to be Bush's campaign Mgr for OH, as I recall)...

I wish there were more public outrage about all this.

The voters who put in provision ballots WERE present when they put in their ballots. There is absolutely no purpose served by requiring them to appear a second time, other than election tampering. These are the kinds of issues that should show every Democrat why it is absolutely essential that we seat every federal judge we are entitled to and stop allowing the Republicans to stall that process. If that provisional ballot rule is enforced, that should end up in a Federal court pronto.

We're going to be calling them all and if necessary, picking them up and driving them in to have their votes counted. This new in-person rule is positively insane.

We also found an irregularity at one precinct in my district: more people signed in to vote than votes that were cast so that should work in Herring's favor, too, even though there weren't a lot of those.

Obenshain.must.not.win.

The instruction led the Republican-majority Fairfax County Electoral Board to extend their deadline for voters to come in and plead their case until Tuesday. On Saturday, according to Tribbett, they voted "2-0 with 1 abstaining to condemn (the) state board of elections ruling prohibiting legal rep for voters not here."

The action to allow voters more time to argue for inclusion of their provisional ballots also resulted in plaudits for Fairfax County Electoral Board member Brian Schoeneman --- a Republican and former Bush Administration staffer --- from normally ideological opponents, and also condemnation from at least one of his fellow Republicans, who asked: "Why is Brian Schoeneman, who purports to be a Republican, helping Democrats by extending this deadline?"

For his part, Schoeneman took to Twitter to explain what was going on and to respond to questions about the ruling. He tried to calm concerns by asking that folks "don't blow the SBE issue out of proportion. This is simply a disagreement between lawyers. It has little impact on voters."

"To be clear, this wasn't an SBE change. They believe this has always been their policy," he said, adding "This was reminder guidance to localities. Not every locality had our past practice."

That practice, he explained, is "to allow voters to present us with evidence as to why they voted provisionals. It's a courtesy to them." He tweeted late Saturday that provisional voters "don't 'need' to come in. They may if they want. They are given a sheet when they vote provisional explaining it." Schoeneman went on to vow, "we will review every ballot on a case by case basis and decide each ballot, regardless of whether the voter appears."

so I just passed this along to them in case they missed it.

If they disallow the provisional votes for folks who don't show up merely because they didn't show up, and the count doesn't flip, you can bet this is going to court.

No disrespect to Florida, but this is starting to look like their kind of election circus.

We are calling and canvassing everyone who voted provisionally (who is a likely Dem) to get them to the Fairfax Cty Govt Center by 4pm Monday in order for their votes to be counted.

We do not have anyone here who speaks Korean and have run into one or two voters who we're unable to communicate with.

We need someone to speak briefly with these voters to explain what is needed of them - over the phone from another state is fine. Please PM me or leave a message here if you can help.
