Judge in Colorado theatre shootings indefinitely postpones trial while more psych tests eyed

CENTENNIAL, Colo. - The judge in the Colorado theatre shootings case has indefinitely postponed the trial of suspect James Holmes so attorneys can argue whether he should undergo another psychiatric evaluation.
District Judge Carlos Samour scheduled hearings on the issue for Dec. 17 and 18.
Holmes pleaded not guilty by reason of insanity to charges of killing 12 people and injuring 70 in a Colorado movie theatre in July 2012. Prosecutors are seeking the death penalty and want Holmes to undergo further evaluation of his sanity.

But by all means, let's make sure he's well accommodated.....poor fellow.
What a fucked up judicial system we have in this country. I don't give a shit whether about it's long storied tradition, and how it's better than other countries. It's still plenty screwed up, and nobody cares about the victims in what should be open and shut cases.

(14,779 posts)Thus if you want to blame anyone, blame the Prosecution. I suspect previous Psychiatric exams by Doctors selected by the PROSECUTION, supported the reports of the Defense doctors that more then justify that the shooter was insane. Rather then cut a deal sending the shooter to a Psychiatric Hospital for the rest of his life, the Prosecution is going to spend tax payer's money on another set of Psychiatrists hoping what they will say shows the shooter was NOT insane.
This is like the Penn State Shooter in 1996, she took her 7mm Mauser and started to shoot people on the Penn State Main Campus, one student who was near where she was rushed her position and took the rifle away from her after she had killed at two people (She tried to knife the student who took her rifle away). When the shooting first occurred the local District Attorney went on the Air waves saying he would seek the death penalty for the shooter, later on when it came close to trial, he agreed to 3rd degree murder and a 30 year sentence in a State Psychiatric Hospital. The shooter was in custody and not on bail, but it still took 20 months of Psychiatric exams and medication to get to the point where a deal could be agreed to by the DA and the Defendant.

The reason for the change was the DA was it was clear the Shooter had been insane and no reasonable jury would find otherwise, thus the DA agreed to the deal. The defense agreed to the agreement for the Shooter clearly needed help.
I suspect the same thing is this case, the Prosecutor wants to get a Death Penalty, but so far all of the evidence supports the position the shooter was insane.
For you conspiracy nuts, the Prosecutor of Jill Robins, the Penn State Shooter was Ray Gricar, the missing Center County DA, who disappearance in 2005 is involved with the Sandusky Penn State Scandal.
